EXPLANATORY NOTES Clause 1 of the Bill would repeal section 3 of the Services Charges Act to remove registration fees charged under the Condominium Act. The method of assessing those fees has changed and those fees no longer come under the purview of the Services Charges Act. Rather, they are addressed under the Condominium Act and regulations and a directive of the minister under that legislation. Clause 2 of the Bill is a consequential amendment to the Condominium Act to allow the minister to prescribe fees and forms for the purpose and administration of that Act. This provision was inadvertently omitted from amendments stemming from the Regulatory Reform Project.
A BILL AN ACT TO AMEND THE SERVICES Analysis 1. S.3 Rep. 2. Consequential amendment Be it enacted by the Lieutenant-Governor and House of Assembly in Legislative Session convened, as follows: SN1998 cS-13.2 1. Section 3 of the Services Charges Act is repealed. Consequential amendment 2. (1) Subsection 15(2) of the Condominium Act is amended by adding immediately after the word "form" the phrase "prescribed by the minister". (2) The Act is amended by adding immediately after section 20 the following: Fees and forms 21. The minister may prescribe fees and forms for the purpose and administration of this Act.
