EXPLANATORY NOTE

This Bill would amend the House of Assembly Act to provide authority for the Speaker of the House of Assembly to create and define the parliamentary precinct within and around the east block of the Confederation Building Complex.

Be it enacted by the Lieutenant-Governor and House of Assembly in Legislative Session convened, as follows:

        1. The House of Assembly Act is amended by adding immediately after section 19.1 the following:

PART I.1
PARLIAMENTARY PRECINCT

Parliamentary precinct

   19.2 (1) In this Part

             (a)  "commission" means the Commission of Internal Economy referred to in the Internal Economy Commission Act; and

             (b)  "speaker" means the Speaker of the House of Assembly.

             (2)  The speaker may with the concurrence of the commission make an order to define the parliamentary precinct of the House of Assembly

             (a)  within the Confederation Building Complex;

             (b)  within the common public areas of the east block of the Confederation Building Complex; and

             (c)  in the parking lot next to the north east entrance of the east block and in front of the east block of the Confederation Building Complex.

             (3)  For the purpose of subsection (2), the speaker and the minister of the Crown who is responsible for the Confederation Building Complex may enter into an arrangement to jointly control and to provide security in the common areas, lobby and entrances into the east block of the Confederation Building Complex, the parking area next to the north east entrance and in front of the east block and the roadways leading into the east block entrances from Prince Philip Parkway.

             (4)  The parliamentary precinct of the House of Assembly, as defined by order under subsection (2), falls under the control and management of the speaker.

             (5)  The speaker may, subject to an order of the House of Assembly, take any action he or she considers necessary for the control and management of the parliamentary precinct.

             (6)  Nothing in this section shall be taken to derogate from the powers, privileges and immunities of the House of Assembly and of the members and committees of the House of Assembly under any other law.

             (7)  The order made by the speaker under subsection (2) is subordinate legislation for the purpose of the Statutes and Subordinate Legislation Act.
