EXPLANATORY NOTES Clause 1 of the Bill would add a definition of "industrial customer" to section 2 of the Taxation of Utilities and Cable Television Companies Act. This reference would replace the list of those companies contained in the Schedule of the Act, which would stand repealed. Clauses 2 and 3 of the Bill are consequential to the amendment contained in clause 1, and clause 4 of the Bill would repeal the Schedule to the Act. |
A BILL AN ACT TO AMEND THE TAXATION OF UTILITIES AND CABLE TELEVISION COMPANIES ACT Analysis 1.

S.6 Amdt. 4. Sch. Rep. Be it enacted by the Lieutenant-Governor and House of Assembly in Legislative Session convened, as follows: SNL1992 cT-0.1 1. Section 2 of the Taxation of Utilities and Cable Television Companies Act is amended by adding immediately after paragraph (e) the following: (e.01) "industrial customer" means a person purchasing power from the Newfoundland and Labrador Hydro Electric Corporation, a corporation continued under the Hydro Corporation Act and its successors and assigns, other than a utility as defined in subparagraphs (h)(i), (ii.1), (iii) and (iv), supplied from the bulk transmission grid at voltages of 66 KV or greater on the primary side of transformation equipment directly supplying the person; 2. Subsection 5(8) of the Act is repealed and the following substituted: (8) Subsection (1) shall not apply with respect to the gross revenue of the utility referred to in subparagraph 2(h)(ii) where that gross revenue is derived from an industrial customer of that utility. 3. Subsection 6(8) of the Act is repealed and the following substituted: (8) Subsection (1) shall not apply with respect to the gross revenue of the utility referred to in subparagraph 2(h)(ii) where that gross revenue is derived from an industrial customer of that utility. 4.
