EXPLANATORY NOTES This Bill would amend the House of Assembly Act. The Bill would · reduce the number of members of the House of Assembly to 40; · effect a reorganization of the boundaries of electoral districts in the province; · set a date when a general election shall be held in 2015 as a result of an overlap with the federal election; · establish a mechanism to resolve future overlaps between federal and provincial elections; and · provide for an exception to the requirement to hold a by-election where a seat in the House of Assembly becomes vacant 6 months or less before the day a general election is required to be held. |

Commencement Be it enacted by the Lieutenant-Governor and House of Assembly in Legislative Session convened, as follows: RSNL1990 cH-10 as amended 1. Section 3 of the House of Assembly Act is repealed and the following substituted: Duration of House of Assembly 3.
(1) Notwithstanding another provision of this section, the Lieutenant-Governor
may, by proclamation in Her Majesty's name, prorogue or dissolve the House of
Assembly when the Lieutenant-Governor sees fit.
(2) A polling day at a general election shall
be held on the second Tuesday in October, 2007 and afterward on the second
Tuesday in October in the fourth calendar year following the polling day at the
most recently held general election.
(3) Notwithstanding subsection (2) and section
3.1, the polling day for a general election in 2015 shall be held on November
30, 2015. (4) Notwithstanding subsection (2), if, on April 1 in the year that a general election is to be held under that subsection, the Premier is of the opinion that the day that would be an ordinary polling day under that subsection is not suitable for that purpose because it overlaps with a federal election, the Premier shall choose an alternative day in accordance with subsection (5) and shall provide advice to the Lieutenant-Governor that a general election be held on that alternative day. (5) The last Monday in November in the fourth calendar year following the ordinary polling day for the most recently held general election is the alternative day referred to in subsection (4). 2. Subsection 4(1) of the Act is repealed and the following substituted: Number of members 4. (1) The House of Assembly shall consist of 40 members. 3. Section 5 of the Act is repealed and the following substituted: Districts 5. Each district for which a member shall be returned to the House of Assembly is listed below and is more particularly described and delineated in the Schedule, and each district shall return one member to the House of Assembly: Baie Verte - 4. Section 54 of the Act is amended by renumbering it as subsection 54(1) and by adding immediately after that subsection the following: (2) Subsection (1) does not apply where a vacancy in the House of Assembly occurs 6 months or less before the day upon which a general election is required to be held under (a) subsection 3(2); or (b) subsections 3(4) and (5). 5. The Schedule to the Act is repealed and the following substituted: Schedule

Note: This District includes the communities of Cape Ray, Grand Bay West, Channel-Port aux Basques, Margaree, Fox Roost, Isle aux Morts, Burnt Islands, Rose Blanche, Harbour le Cou, Petites, La Poile, Grand Bruit, Burgeo, Ramea, and Grey River. Burin - Grand Bank The District of Burin - Grand Bank shall

Provincial Boundary of Newfoundland and Labrador and the northern shoreline of
the Then running north along the said Provincial Boundary to its intersection with the Parallel of 52° north latitude; Then running due west along the Parallel
of 52° north latitude to its intersection with
the Then running due north along the Then running in a general southeasterly
direction along the sinuosities of Hamilton Inlet, Then running in a general southwesterly
direction along the sinuosities of the shoreline to the point of beginning,

Conception Bay South The District of Conception Bay South
shall consist of and include all that part of the Beginning at the intersection of the

Commencement 8. (1) Sections 2, 3 and 5 of this Act come into force immediately after the dissolution of the Forty-Seventh General Assembly. (2) Notwithstanding subsection 20(7) of the House of Assembly Accountability, Integrity and Administration Act, section 7 of this Act comes into force on the day immediately following the general election which occurs immediately after the coming into force of this Act. ©Queen's Printer |
