Food Premises Regulations (Amendment)
under the
Food and Drug Act

Under the authority of section 3 of the Food and Drug Act, I make the following regulations.

as amended

        1. (1) Paragraph 2(l) of the Food Premises Regulations is amended by deleting the phrase "an eating establishment" and substituting the phrase "a food premise".

             (2)  Paragraph 2(m) of the regulations is amended by deleting the word "owner" the second time it appears and substituting the word "proprietor".

             (3)  Section 2 of the regulations is amended by adding immediately after paragraph (o) the following:

          (o.1)  "sanitary facility" means any room equipped with appropriate water closets, water closet stalls, urinals and lavatories as identified in Part 3 of the National Building Code (Canada);

             (4)  Paragraph 2(s) of the regulations is amended by deleting the phrase "or laundered for reuse".

             (5)  Paragraph 2(t) of the regulations is amended by deleting the words "the method" and substituting the phrase "an accredited method".

        2. (1) Paragraph 3(c) of the regulations is amended by deleting the word "except" and substituting the word "or".

             (2)  Paragraph 3(d) of the regulations is amended by deleting the word "charitable" and substituting the phrase "not for profit".

        3. Subparagraph 5(2)(b) of the regulations is repealed and the following substituted:

             (b)  furnish the inspector with 2 copies of the plans and specifications of the

                      (i)  food premises,

and where municipal services are unavailable 2 copies of the plans and specifications of the

                     (ii)  water supply, and

                    (iii)  sewage disposal system.

        4. Paragraph 6(e) of the regulations is repealed and the following substituted:

                     (e)  be appropriately illuminated and equipped with adequate ventilation systems in accordance with the National Building Code (Canada).

        5. Paragraph 8(2)(a) of the regulations is amended by deleting the word "and" at the end of that paragraph and substituting the word "or".

        6. Paragraph 9(d) of the regulations is amended by deleting the words "perishable and".

        7. Section 16 of the regulations is amended by adding immediately after the word "oil" the phrase "if packaged in single use portions".

        8. Subsection 29(1) of the regulations is amended by deleting the word "or" the second time it appears and substituting the word "and".

        9. Paragraph 39(2)(a) of the regulations is amended by deleting the figure "5°" and substituting the figure "4°".

     10. Subsection 47(3) of the regulations is repealed and the following substituted:

             (3)  Where food premises have been closed under this section, an inspector may arrange for a notice to be placed in a conspicuous place on the outside or inside of the building, in a window or elsewhere, indicating to the general public that the food premise has been closed by the Department of Health.
