Milk Regulations, 1998 (Amendment)
under the
Milk Scheme, 1998
and the
Natural Products Marketing Act

Under the authority of section 8 of the Milk Scheme, 1998 and the Natural Products Marketing Act, the Dairy Farmers of Newfoundland and Labrador make the following regulations.

        1. Section 2 of the Milk Regulations, 1998 is amended by adding immediately after paragraph (c) the following:

          (c.1)  "pay period" means a fiscal pay period agreed to between registered producers and registered processors and subject to change by agreement between them, and at the conclusion of which monetary payments shall be made by registered processors to registered producers and the DFNL;

        2. Subsection 19(1) of the regulations is repealed and the following substituted:

Excess production

      19. (1) If a registered producer produces during the pay period milk in an amount in excess of 110% of his or her fluid milk quota, as calculated by the DFNL for that pay period, the DFNL shall, by notice in writing, impose upon that registered producer a penalty in an amount equal to $0.20 for each litre on that excess production over 110% which shall be deducted by the registered processor.

          (1.1)  The penalty imposed under subsection (1) shall be paid in full to the DFNL during the pay period immediately following the pay period in which the penalty was imposed.

        3. Subsections 20(3) and (4) of the regulations are repealed.
