Lottery Licensing Regulations (Amendment)
under the
Criminal Code
(M.C. 1081-82) &
(M.C. 2003-0065)

Under the authority granted by the Lieutenant-Governor in Council by Minute in Council 1081-82 and subsection 207(2) of the Criminal Code, I make the following regulations.

        1. Paragraph 2(k) of the Lottery Licensing Regulations is repealed and the following substituted:

             (k)  "licensee" means an organization licensed to conduct or manage a lottery scheme under these regulations and includes a member organization of an umbrella association;

 

        2. Section 30 of the regulations is amended by renumbering it as subsection (1) and adding immediately after subsection (1) the following:

             (2)  It is an offence under the Tobacco Control Act to give tobacco as a prize to a person under the age of 19 years.

             (3)  A prize of a firearm shall not be given to a person who is not authorized under the Firearms Act (Canada) to possess a firearm.

 

        3. Paragraph 38(2)(e) of the regulations is repealed and the following substituted:

             (e)  GAMES OF CHANCE - Where a financial report is required, a licence fee shall accompany the report in the amount of 1% of the total amount of the retail value of prizes and cash given as prizes except in the case of a wheel of fortune a fee of $5 for each wheel per event and in the case of a game of chance a fee of $5 for each game per event;

 

        4. (1) Schedule A of the regulations is amended by adding immediately after rule 5 the following:

 

      5.1 Once a caller has started to call a number on a ball the caller shall finish calling it.

             (2)  Rule 16 of Schedule A of the regulations is repealed and the following substituted:

      16. Discounted prices shall not be allowed for bingo cards or paper, including media bingo cards, unless separate and distinct cards are used.

 

        5. (1) Schedule C of the regulations is amended by adding immediately after rule 5 the following:

      5.1 Once a caller has started to call a number on a ball the caller shall finish calling it.

             (2)  Rule 16 of Schedule C of the regulations is repealed and the following substituted:

      16. Discounted prices shall not be allowed for bingo cards or paper, including media bingo cards, unless separate and distinct cards are used.

 

        6. (1) Rule 10 of Schedule D of the regulations is repealed and the following substituted:

      10. Discounted prices shall not be allowed for ticket sales, unless there is a method that ensures financial accountability that has been approved by the division.

             (2)  Rules 17 and 18 of Schedule D of the regulations is repealed and the following substituted:

      17. The licensee may accept cheques or credit payments, and shall be responsible for ensuring that the proceeds from ticket sales are validated before the prize is awarded.  If the proceeds cannot be verified for a winning ticket a subsequent draw shall take place to award the prize.

      18. (1) A licensee may operate an early bird draw.

             (2)  An early bird draw shall not be held unless approved by the division and a minimum of 14 days is allotted to account for tickets before the draw takes place.

             (3)  A shorter period than that provided in subrule (2) may be approved by the division where requested in writing setting out the method that will be used to ensure accountability.

             (4)  The cut-off date for an early bird draw shall be printed on the ticket.

             (3)  Rule 22 of Schedule D of the regulations is repealed and the following substituted:

      22. Where the winner is under 19 years of age, the licensee shall deliver the prize to his or her legal guardian.

 

        7. Rule 15 of Schedule F of the regulations is amended by renumbering it as subrule (1) and adding immediately after it the following:

             (2)  A licensee shall ensure that monte carlo wheels of fortune, tables and games are conducted by representatives of the licensee, and includes dealers for blackjack and poker tables.

             (3)  A representative shall not wager a bet while conducting a wheel of fortune, table or game.

 

        8. (1) Rule 2 of Schedule G of the regulations is repealed and the following substituted:

        2. Discounted prices shall not be allowed for ticket sales, unless there is a method that ensures financial accountability that has been approved by the division.

             (2)  Rule 19 of Schedule G of the regulations is repealed and the following substituted:

      19. A spreadsheet, as approved by the division, or a copy of all entries shall be received by the division, or postmarked, not later than 4:00 p.m. of the day that is 24 hours before the commencement of the games.  Failure to comply with this, may result in the licence being revoked and participants' monies being refunded.
