of the Supreme Court, 1986 (Amendment) (Filed
Under the authority of section 55 of the Judicature Act, the Rules Committee of
the Trial Division makes the following Rules. Dated at Barry R. Sparkes, Q.C. RULES Analysis 1.
Rule 18A.02 Amdt. 2.
Rule 18A.09 Amdt. 3. Commencement 1. Rule 18A.02(1)(d) of the Rules of the Supreme Court, 1986 is amended as follows: (a) sub-clause (iv) is amended by deleting the words "more than six expert witnesses" and substituting the words "more than five expert witnesses"; (b) sub-clause (v) is amended by deleting the words "three or more unrelated plaintiffs or defendants" and substituting the words "three or more unrelated plaintiffs, defendants or third parties"; (c) sub-clause (vi) is amended by deleting the word "and"; (d) sub-clause (vii) is amended by deleting the semi-colon and substituting a comma; and (e) by adding as sub-clause (viii) (viii) trial of any medical or hospital malpractice claim; and 2. (1) Rule 18A.09 of the Rules is amended by deleting paragraphs (1) and (2) and substituting the following: Miscellaneous 18A.09. (1) A judge who acts as a case management judge or alternate case management judge may preside at the trial of the proceeding. (2) Rule 18A.09 of the Rules is amended by renumbering paragraph (3) as paragraph (2). Commencement 3. These amendments come into force on ©Earl G. Tucker, Queen's Printer |
