Town of Conception Bay South Violation Notice Regulations
under the
Municipalities Act, 1999
and the
Urban and Rural Planning Act, 2000

Under the authority of section 421.3 of the Municipalities Act, 1999 and section 39.3 of the Urban and Rural Planning Act, 2000, I make the following regulations.

Short title

        1. These regulations may be cited as the Town of Conception Bay South Violation Notice Regulations.

Definitions

        2. In these regulations "violation notice" means a violation notice issued in accordance with section 421.1 of the Municipalities Act, 1999 or section 39.1 of the Urban and Rural Planning Act, 2000 with respect to a regulation referred to in section 3.

Violation notices

        3. The town council of the Town of Conception Bay South may issue violation notices with respect to a failure to comply with a provision of the Occupancy and Maintenance Regulations under the Urban and Rural Planning Act, 2000 or a provision of the following regulations enacted by the town council under the Municipalities Act, 1999 or the Urban and Rural Planning Act, 2000:

             (a)  Conception Bay South Development Regulations;

             (b)  The Town of Conception Bay South Waste Disposal and Property Regulations;

             (c)  Town of Conception Bay South Animal Control Regulations;

             (d)  Town of Conception Bay South Anti Litter Regulations;

             (e)  Town of Conception Bay South Building Regulations;

             (f)  Town of Conception Bay South Fence Regulations;

             (g)  Town of Conception Bay South Garbage and Refuse Regulations;

             (h)  Town of Conception Bay South Mobile Canteen and Vendor Regulations;

              (i)  Town of Conception Bay South Noise and Nuisance Regulations;

              (j)  Town of Conception Bay South Open Air Fire Regulations;

             (k)  Town of Conception Bay South Road Reservation Regulations; and

              (l)  Town of Conception Bay South Snow Clearing Regulations.

Time of payment

        4. Where a violation notice has been issued by the town council of the Town of Conception Bay South

             (a)  a voluntary payment made to the Town of Conception Bay South with respect to that notice shall be made by the recipient of that notice not later than 7 days after the issuance of the notice to that recipient; and

             (b)  notwithstanding paragraph (a), a voluntary payment made to the Town of Conception Bay South with respect to that notice after the time referred to in paragraph (a) shall be made by the recipient of that notice not later than 14 days after the issuance of the notice to that recipient.

Amount of payment

        5. Where a violation notice has been issued by the town council of the Town of Conception Bay South

             (a)  a voluntary payment to the Town of Conception Bay South made within the time referred to in paragraph 4(a) with respect to that notice shall be $50; and

             (b)  a voluntary payment to the Town of Conception Bay South made with respect to that notice within the time period referred to in paragraph 4(b) shall be $75.

Offence penalty

        6. Where a person has received a violation notice and is convicted of an offence with respect to the same matter for which that notice was issued, the penalty for that offence shall be $100.

Commencement

        7. These regulations come into force on March 1, 2015.
