Public Sector Compensation Transparency Regulations (Amendment)
under the
Public Sector Compensation Transparency Act
(O.C. 2018-255)

Under the authority of section 12 of the Public Sector Compensation Transparency Act, the Lieutenant-Governor in Council makes the following regulations.

        1. Section 7 of the Public Sector Compensation Transparency Regulations is amended by adding immediately after section (5) the following:

             (6)  This section does not apply to employees of the legislative branch.

 

        2. The regulations are amended by adding immediately after section 7 the following:

Time limits re: employees of legislative branch

      7.1 (1) The clerk shall, not later than March 31 of each year, provide written notice to all of the employees of the legislative branch that the information in section 3 of the Act will be disclosed.           

             (2)  An employee of the legislative branch may file an application under subsection 7.1(1) of the Act not later than April 16 of each year.

             (3)  The clerk shall provide his or her decision regarding the application not later than April 30 of each year.

             (4)  An employee of the legislative branch who is dissatisfied with the decision of the clerk may file an appeal under subsection 7.1(2) of the Act not later than May 14 of each year.

             (5)  The speaker shall provide his or her decision regarding the appeal not later than May 30 of each year.

 

        3. Section 8 of the regulations is repealed and the following substituted:

Disclosure re: exemptions

        8. The following information shall be included in disclosure under section 9 of the Act:

             (a)  a statement that no information was exempted from disclosure under the Act where no information was exempted from disclosure under the Act;

             (b)  a statement that information regarding one employee was exempted from disclosure under the Act where information regarding one employee was exempted from disclosure under the Act; or

             (c)  a statement indicating the number of employees whose information was exempted from disclosure under the Act and the aggregate total compensation exempted from disclosure.

 

        4. The Schedule to the Act is amended by

             (a)  deleting the reference "Electoral Districts Boundaries Commission";

             (b)  deleting the reference "Government Purchasing Agency" and substituting the reference "Public Procurement Agency"; and

             (c)  deleting the reference "Mental Health Review Board.
