Registered Nurses Regulations (Amendment)
under the
Registered Nurses Act, 2008

Under the authority of section 11 of the Registered Nurses Act, 2008, the Council of the College of Registered Nurses of Newfoundland and Labrador, with the approval of the Minister of Health and Community Services, makes the following regulations.

        1. The Registered Nurses Regulations are amended by adding immediately after section 5 the following:

Emergency licence

      5.1 (1) Where the executive director or the council determines that there is an immediate need for nursing services due to an actual or potential threat to public safety, health or welfare or where the minister or the federal Minister of Health makes a request, the executive director may issue an emergency registration and licence.

             (2)  A person may be issued an emergency registration and licence for a period of time determined by the executive director or the council where he or she

             (a)  provides proof satisfactory to the executive director or the council that he or she

                      (i)  is licensed to practice nursing in another jurisdiction in Canada,

                     (ii)  has successfully completed a nursing education program approved by the council in Canada within the past 12 months and has not failed a writing of the approved registered nurse examination, or

                    (iii)  was previously licensed to practice nursing in the province;

             (b)  provides proof satisfactory to the executive director or the council that his or her licence has not been revoked, suspended or restricted or has conditions attached by reasons of disciplinary or other regulatory measures in another jurisdiction;

             (c)  provides proof of identification as required by the executive director or the council; and

             (d)  satisfies any other requirements as the executive director or the council may determine are necessary and practicable in the circumstances.

             (3)  An emergency licence issued under subsection (2) may be renewed as considered necessary by the executive director or council.

             (4)  The executive director or the council may impose terms, conditions or restrictions on an emergency licence issued under subsection (2).

             (5)  The executive director or the council may terminate an emergency licence issued under subsection (2) at any time.
