Public Procurement Regulations (Amendment)

Public Procurement Act

Under the authority of section 28 of the Public Procurement Act, the Lieutenant-Governor in Council makes the following regulations.

Evaluation of bids

        1. Subsection 14(1.1) of the Public Procurement Regulations is repealed and the following substituted:

         (1.1)  Notwithstanding section 17, a public body shall apply a 10% reduction to the bid price of a provincial supplier for the purpose of evaluating the provincial supplier's bid under subsection (1) where

             (a)  in the case of a public body referred to in subsection 5(1), the procurement is for

                      (i)  goods, services or leases of space with an estimated value of less than $528,300, and

                     (ii)  public works with an estimated value of less than $5,283,200;

             (b)  in the case of a public body referred to in subsection 5(2), the estimated value of the procurement is less than the applicable threshold in paragraph 5(2)(a), (b) or (c); and

             (c)  in the case of a public body referred to in subsection 5(3), the estimated value of the procurement is less than the applicable threshold in paragraph 5(3)(a), (b) or (c).
