Physiotherapy Regulations (Amendment)
under the
Physiotherapy Act, 2006

Under the authority of section 9 of the Physiotherapy Act, 2006, the Council of the Newfoundland and Labrador College of Physiotherapists, with the approval of the Minister of Health and Community Services, makes the following regulations.

        1. (1) Section 4 of the Physiotherapy Regulations is amended by deleting the words "he or she" wherever they appear and substituting the words "the applicant". 

             (2)  Paragraph 4(1)(c) of the regulations is repealed and the following substituted:

             (c)  successfully completes the examinations required by the council; 

             (3)  Subsection 4(1) of the regulations is amended by adding immediately after paragraph (c) the following:

          (c.1)  provides proof, in the form set by the council, that the applicant has completed a mentorship program under subsection 5(5) in the manner and for the duration approved by the council;

             (4)  Subsection 4(3) of the regulations is amended by deleting the words "physiotherapy competency examination approved" and substituting the words "examinations required".

 

        2. Section 5 of the regulations is repealed and the following substituted:

Conditional registration

        5. (1) An applicant may be granted conditional registration as a physiotherapist where the applicant applies for conditional registration in the prescribed form and

             (a)  passes the written examination required by the council;

             (b)  complies with the "Conditions of Registration" and "Conditions of Practice" for conditional registration approved by the council;

             (c)  provides proof of having obtained professional liability insurance satisfactory to the council or a statement from an insurer of an intention to provide insurance; and

             (d)  pays the required fees.

             (2)   Notwithstanding subsection (1), an applicant who has been previously registered in this jurisdiction or another jurisdiction recognized by the college and who meets the requirements of subsection 4(1), but who has not met the requirements for active registration under subsection 4(2), may be granted conditional registration where that applicant enters and completes a remediation program approved by the council.

             (3)  A conditional registration may be reviewed, revised or revoked by the council where the circumstances under which the conditional registration was given change.

             (4)  A person holding a conditional registration shall not serve as a member of the council, sit on college committees or be entitled to vote at meetings of the college.

             (5)  A person holding a conditional registration shall not practice physiotherapy unless the person is mentored, in a manner acceptable to the council, by a person with active registration as a physiotherapist whose registration is not subject to conditions or restrictions.

 

        3. Subsection 6(1) of the regulations is amended by deleting the words "he or she" and substituting the words "the applicant".

 

        4. Subsection 7(1) of the regulations is amended by deleting the words "he or she" and substituting the words "the physiotherapist".
