Registered Nurses Regulations (Amendment)
under the
Registered Nurses Act, 2008

Under the authority of section 11 of the Registered Nurses Act, 2008 the Council of the College of Registered Nurses of Newfoundland and Labrador, with the approval of the Minister of Health and Community Services, makes the following regulations.

        1. Section 2 of the Registered Nurses Regulations is amended by adding immediately after paragraph (a) the following:

         (a.1)  "employer sponsor" means

                      (i)  a regional health authority established under the Regional Health Authorities Act, or

                     (ii)  a person or body approved by the council or the executive director;

 

        2. (1) Subsection 3(1) of the regulations is amended by

             (a)  deleting the words "he or she" wherever they appear and substituting the words "the person"; and

             (b)  deleting the words "his or her" and substituting the word "the".

             (2)  Subsection 3(2) of the regulations is amended by

             (a)  deleting the words "who obtained his or her education" and substituting the words "whose education was obtained"; and

             (b)  deleting the words "he or she" and substituting the words "the person".

             (3)  Subsection 3(3) of the regulations is repealed and the following substituted:

             (3)  A person applying to be registered as a registered nurse whose nursing education was obtained outside Canada shall, in addition to the requirements in subsection (1),

             (a)  submit a transcript from the educational institution where the person's nursing education was completed;

             (b)  provide written confirmation of the contents of the nursing education program that the person completed, including hours spent in each area of the program and other information required by the council;

             (c)  submit a letter of good standing from each jurisdiction where the person is currently, or was previously, registered or licensed; and

             (d)  submit a professional reference satisfactory to the council.

             (4)  Subsection 3(4) of the regulations is amended by deleting the words "the person completed his or her nursing education" and substituting the words "the person's nursing education was completed".

             (5)  Subsection 3(5) of the regulations is repealed and the following substituted:

             (5)  Notwithstanding subsection (3), a person applying to be registered to practise nursing may be registered in accordance with subsection (6) where all of the following apply:

             (a)  the person's nursing education was obtained outside Canada;

             (b)  at the time of application the person is not practising in Canada; and

             (c)  the person cannot provide evidence satisfactory to the council of the person's nursing education or registration from each jurisdiction where the person is currently, or was previously, registered or licensed.

             (6)  Subsection 3(6) of the regulations is amended by

             (a)  deleting the words "he or she" and substituting the words "the person"; and

             (b)  deleting the words "his or her" and substituting the words "the person's".

 

        3. (1) Subsection 4(1) of the regulations is amended by deleting the words "he or she" and substituting the words "the person".

             (2)  Subsection 4(4) of the regulations is amended by deleting the words "his or her" and substituting the words "the person's".

 

        4. Subsection 5(1) of the regulations is amended by deleting the words "he or she" wherever they appear and substituting the words "the person".

 

        5. Subsection 5.1(2) of the regulations is amended by

             (a)  deleting the words "he or she" wherever they appear and substituting the words "the person"; and

             (b)  deleting the words "his or her" and substituting the words "the person's".

 

        6. (1) Subsection 6(1) of the regulations is repealed and the following substituted:

Interim licence

        6. (1) A person may be granted an interim licence where the person is

             (a)  registered on the provisional register; or

             (b)  registered in accordance with section 3 and meets the requirements in paragraphs 5(1)(a) and (b) but does not meet the requirements in paragraph 5(1)(c).

             (2)  Subsection 6(2) of the regulations is amended by deleting the words "he or she" and substituting the words "the person".

             (3)  Section 6 of the regulations is amended by adding immediately after subsection (2) the following:

         (2.1)  Where a person is granted an interim licence under paragraph 6(1)(b), the person shall

             (a)  practise as a registered nurse for at least 450 hours within the 24 month period following the date of issuance of the interim licence or another time approved by the council; and

             (b)  provide proof satisfactory to the council of an employer sponsor.

 

        7. Section 7 of the regulations is amended by

             (a)  deleting the words "he or she" wherever they appear and substituting the words "the person"; and

             (b)  deleting the words "his or her" wherever they appear and substituting the words "the person's".

 

        8. The regulations are amended by adding immediately after section 7 the following:

Authority to prescribe

      7.1 (1) A licence issued to a registered nurse under section 5 may include the authority to prescribe where the registered nurse provides the following:

             (a)  satisfactory proof of the successful completion of a registered nurse prescribing education program approved by the council;

             (b)  proof satisfactory to the council of an employer sponsor; and

             (c)  a declaration from the registered nurse stating that the registered nurse will only prescribe in accordance with the standards established by the council.

             (2)  A registered nurse whose licence includes the authority to prescribe may, in accordance with the standards established by the council,

             (a)  prescribe a drug;

             (b)  order laboratory or other permitted tests; and 

             (c)  make referrals to other health professions, including medical practitioners licensed under the Medical Act, 2011.

 

        9. Paragraph 8(1)(b) of the regulations is amended by deleting the words "he or she" and substituting the words "the registered nurse".

 

      10. (1) Subsection 9(1) of the regulations is amended by deleting the words "he or she" wherever they appear and substituting the words "the registered nurse".

             (2)  Subsection 9(2) of the regulations is repealed and the following substituted:

             (2)  Where a registered nurse who has not written the nurse practitioner examination is granted an interim licence, the registered nurse shall write the exam at the first available sitting or at another time approved by the council.

             (3)  Section 9 of the regulations is amended by adding immediately after subsection (2) the following:

         (2.1)  A registered nurse may be granted interim licensure to practise as a nurse practitioner where the registered nurse meets the requirements in paragraph 8(1)(a) but does not meet the requirements in paragraph 8(1)(b).

         (2.2)  Where a registered nurse is granted an interim licence under subsection (2.1), the registered nurse shall

             (a)  practise as a nurse practitioner for at least 900 hours within the 36 month period following the date of issuance of the interim licence or another time approved by the council; and

             (b)  provide proof satisfactory to the council of an employer sponsor.

 

      11. Subsection 10(1) of the regulations is amended by deleting the words "his or her" and substituting the words "the registered nurse's".

 

      12. Paragraph 11(1)(b) of the regulations is amended by deleting the words "his or her" and substituting the words "the registered nurse's".

 

      13. (1) Section 12 of the regulations is amended by

             (a)  deleting the words "he or she" wherever they appear and substituting the words "the person"; and

             (b)  deleting the words "his or her" wherever they appear and substituting the word "the person's".

             (2)  Section 12 of the regulations is amended by adding immediately after subsection (3) the following:

             (4)  Where a licence to practise nursing referred to in subsection (1) includes authority to prescribe, the person applying for a renewal shall, in addition to the requirements in subsection (1),

             (a)  submit proof satisfactory to the council of an employer sponsor; and

             (b)  provide a declaration that the person will only prescribe in accordance with the standards established by the council.

 

      14. Subsection 16(3) of the regulations is amended by deleting the words "he or she" and substituting the words "the Director of Professional Conduct Review".

 

      15. Subsection 19(2) of the regulations is amended by deleting the words "his or her" and substituting the words "the member's".

 

      16. Section 19.1 of the regulations is amended by

             (a)  deleting the words "his or her" wherever they appear and substituting the words "the person's"; and

             (b)  deleting the words "he or she" wherever they appear and substituting the words "the person".
