Income and Employment Support Regulations (Amendment)
under the
Income and Employment Support Act

Under the authority of section 52 of the Income and Employment Support Act, the Lieutenant-Governor in Council makes the following regulations.

as amended

        1. (1) Paragraph 8(a) of the Income and Employment Support Regulations is amended by deleting the word "or" after subparagraph (xxii), deleting the semi-colon at the end of clause (xxiii)(B) and substituting a comma and the word "or" and adding immediately after subparagraph (xxiii) the following:

               (xxiv)  income received for board and lodging;

             (2)  Subparagraph 8(d)(iii) of the regulations is repealed.

 

        2. Subsection 9(3) of the regulations is amended by deleting the word and reference "or (2)" in the paragraph referring to the value of "BR".

 

        3. Subsection 10(3) of the regulations is repealed and the following substituted:

             (3)  The calculated daily amount is the amount determined as follows:

             (a)  the amount of income support described in subparagraph (i) or (ii), whichever applies,

                      (i)  subsection 13(1) less the amount in subsection 13(2) if applicable and plus the amount in section 16 if applicable, or

                     (ii)  subsection 14(1);

             (b)  plus 40%;

             (c)  less the income described in paragraph 8(c) or 8(d); and

             (d)  divided by 30.

 

        4. (1) Subsection 14(1) of the regulations is amended by deleting the words "with a non-relative".  

             (2)  Subsection 14(2) of the regulations is repealed.

 

        5. Section 15 of the regulations is repealed.

 

        6. Subsection 18(1) of the regulations is amended by deleting the references "section 13, 14 or 15" and substituting the references "section 13 or 14".

 

        7. (1) Paragraph 19(1)(f) of the regulations is repealed and the following substituted:

             (f)  an amount of $105 for each applicant or recipient who is 65 years of age or older and eligible for income support except where within 2 months following

                      (i)  the date of the applicant’s application, the applicant will no longer be eligible for income support, or

                     (ii)  the recipient’s 65th birthday, the recipient will no longer be eligible for income support;

             (2)  Paragraph 19(2)(b) of the regulations is repealed and the following substituted:  

             (b)  the recipient may continue to receive income support under subsection (1), section 13 or 14 and section 16 if applicable for 90 days from the date of admission, and after that time period, the recipient may, on the approval of an officer, continue to receive income support for an additional 90 days under paragraph 16(1)(b) if applicable and an amount of income support up to $175 a month.

             (3)  Subsection 19(3) of the regulations is amended by deleting the references "subsection (1) or sections 13 and 16 if applicable, or section 14 or 15" and substituting the references "subsection (1), section 13 or 14 and section 16 if applicable".

             (4)  Subsection 19(4) of the regulations is amended by deleting the references "subsection (1) or section 13 or 16 if applicable, or section 14 or 15" and substituting the references "subsection (1), section 13 or 14 and section 16 if applicable". 

 

        8. Subsection 50(1) of the regulations is amended by deleting the numbers "13, 14 or 15" wherever they appear and substituting the numbers "13 or 14".

Commencement

        9. These regulations come into force on May 15, 2024.
