Fish Inspection Operations Regulations (Amendment)

Fish Inspection Act

Under the authority of subsection 4(2) of the Fish Inspection Act, I make the following regulations.

        1. (1) Subparagraph 3(3)(a)(i) of the Fish Inspection Operations Regulations is amended by deleting the words "his or her" and substituting the words "the fish harvester's".

             (2)  Paragraph 3(3)(b) of the regulations is amended by deleting the words "his or her" and substituting the words "the person's".

 

        2. Subsection 6(2) of the regulations is amended by

             (a)  deleting the words "his or her agent" and substituting the words "the owner's agent";

             (b)  deleting the words "his or her powers" and substituting the words "the inspector's powers"; and

             (c)  deleting the words "his or her duties" and substituting the words "the inspector's duties".

 

        3. Subsection 7(2) of the regulations is amended by deleting the words "he or she" and substituting the words "the person".

 

        4. (1) Subsection 8(1) of the regulations is amended by deleting the words "his or her" and substituting the words "the owner's".

             (2)  Subsection 8(2) of the regulations is repealed and the following substituted:

             (2)  Where fish is detained under subsection 7(1) in or on an establishment or vehicle owned or leased by a person who is not the owner of the fish or the owner's agent, in addition to provision of the notice of detention to the owner of the fish as required under subsection (1), a copy of the notice of detention shall be delivered to the owner or lessee of the vehicle or establishment or the owner's or lessee's agent.

 

        5. Subsection 9(3) of the regulations is amended by

             (a)  deleting the words "he or she" and substituting the words "the inspector"; and

             (b)  deleting the words "his or her" and substituting the words "the owner's".

 

        6. Section 11 of the regulations is amended by deleting the words "his or her" and substituting the words "the inspector's".

 

        7. Section 22 of the regulations is repealed and the following substituted:

Restrictions on processing of fish

      22. A person shall not process fish that is tainted, decomposed or unwholesome and shall not process dead shellfish, except shrimp, sea cucumber and squid.

 

        8. (1) Subsection 32(2) of the regulations is amended by

             (a)  deleting the words "he or she" wherever they appear and substituting the words "the person"; and

             (b)  deleting the words "his or her" and substituting the words "the person's".

             (2)  Subsection 32(3) of the regulations is amended by

             (a)  deleting the words "he or she" wherever they appear and substituting the words "the person"; and

             (b)  deleting the words "his or her" wherever they appear and substituting the words "the person's".
