Newfoundland and Labrador Hydro - Exploits
Generation Assets Exemption Order
under the
Electrical Power Control Act, 1994
and the
Public Utilities Act

Under the authority of section 5.2 of the Electrical Power Control Act, 1994 and section 4.1 of the Public Utilities Act, the Lieutenant-Governor in Council makes the following Order.

Short title

        1. This Order may be cited as the Newfoundland and Labrador Hydro - Exploits Generation Assets Exemption Order.

Definition

        2. In this Order, "Exploits generation assets" means

             (a)  the hydroelectric generation station and related facilities located at Bishop's Falls;

             (b)  the hydroelectric generation station and related facilities located at Buchans;

             (c)  the hydroelectric generation station and related facilities located at Grand Falls-Windsor;

             (d)  the hydroelectric generation station and related facilities located at Star Lake;

             (e)  the dams, dykes, control structures and other works required for the generation of power at the sites referred to in paragraphs (a), (b), (c) and (d);

             (f)  the transmission facilities necessary to deliver power generated at the sites referred to in paragraphs (a), (b), (c) and (d) to a suitable point of interconnection with existing transmission facilities; and

             (g)  any other facilities and equipment necessary for the facilities, works or equipment referred to in paragraphs (a) to (f).

Exemption

        3. Newfoundland and Labrador Hydro is exempt from the Electrical Power Control Act, 1994 and the Public Utilities Act for all aspects of its activities pertaining to the Exploits generation assets.

Repeal

        4. The Newfoundland and Labrador Hydro-Exploits Generation Exemption Order, Newfoundland and Labrador Regulation 109/13, is repealed.
