Income and Employment Support Regulations (Amendment) No. 3

Under the authority of section 52 of the Income and Employment Support Act, the Lieutenant-Governor in Council makes the following regulations.

NLR 144/04
as amended

        1. (1) Paragraph 2(c.1) of the Income and Employment Support Regulations is repealed and the following substituted:

          (c.1)  "dependent" means a dependent of an applicant or recipient who is a child under the age of 18 years;

             (2)  Paragraph 2(d) of the regulations is repealed.

             (3)  Paragraph 2(h.1) of the regulations is repealed and the following substituted:

         (h.1)  "school-aged dependent" means a dependent who, by December 31 in a year, will be 5 years of age or older;

             (4)  Paragraph 2(j) of the regulations is repealed.

 

        2. Subsection 9(3) of the regulations is amended by deleting the definition of "BR" and substituting the following:

        BR = the amount for boarding or maintaining a residence referred to in subsection 13(1), plus the amount for rent or a mortgage referred to in paragraph 16(1)(a) or (b) if applicable, for the 30-day period before the date of application;

 

        3. Paragraph 10(3)(a) of the regulations is repealed and the following substituted:

             (a)  the amount of income support referred to in subsection 13(1), less the amount in subsection 13(2) if applicable and plus the amount in section 16 if applicable;

 

        4. Subsection 13(1) of the regulations is repealed and the following substituted:

Monthly income support – boarding or maintaining a residence

      13. (1) The monthly amount of income support for each adult who is boarding, renting or owns a residence is an amount up to $561.  

 

        5. Section 14 of the regulations is repealed. 

 

        6. (1) Subsection 16(1) of the regulations is repealed and the following substituted:

Rent or mortgage

      16. (1) The maximum monthly income support

             (a)  for rent is as follows:

                      (i)  for an adult living alone or with a dependent in a rented room or apartment, an amount up to $522, or

                     (ii)  for 2 or more adults living in a rented room or apartment, an amount up to $299 for each adult; and

             (b)  for a mortgage is as follows:

                      (i)  for an adult living alone or with a dependent, for the principal and interest payments on a mortgage relating to the purchase of a principal residence or the financing of repairs to a principal residence, an amount up to $522, or

                     (ii)  for 2 or more adults, for the principal and interest payments on a mortgage relating to the purchase of a principal residence or the financing of repairs to a principal residence, an amount up to $299 for each adult.

             (2)  Subsection 16(3) of the regulations is repealed.

 

        7. Subsection 18(1) of the regulations is amended by deleting the word and number "or 14".

 

        8. (1) Paragraph 19(1)(e) of the regulations is amended by

             (a)  deleting the amount "$400" and substituting the amount "$450"; and

             (b)  deleting the amount "$200" and substituting the amount "$250".

             (2)  Paragraph 19(1)(m) of the regulations is repealed.

             (3)  Subsection 19(1) of the regulations is amended by deleting the word "and" at the end of paragraph (n), deleting the period at the end of paragraph (o) and substituting a semi-colon and the word "and" and adding immediately after paragraph (o) the following:

             (p)  for an applicant or recipient who has a dependent but does not have a spouse or cohabiting partner, an amount of $168.

             (4)  Paragraph 19(2)(b) of the regulations is amended by deleting the word and number "or 14".

             (5)  Subsection 19(3) of the regulations is amended by deleting the word and number "or 14".

             (6)  Subsection 19(4) of the regulations is amended by deleting the word and number "or 14".

             (7)  Paragraph 19(5)(d) of the regulations is repealed and the following substituted:

             (d)  a contribution of up to $522 towards a security deposit, not to exceed three-quarters of the amount of rent payable for one month; 

 

        9. The regulations are amended by adding immediately after section 19 the following:

Overpayment

   19.1 A contribution towards a security deposit received by an applicant or recipient under paragraph 19(5)(d), other than the first contribution received by the applicant or recipient under that paragraph, shall be considered an overpayment and shall be recovered by the minister in the manner prescribed in the Act and these regulations.

 

      10. Subsection 22(4) of the regulations is amended by deleting the amount "$55" and substituting the amount "$100".

 

      11. (1) Paragraph 23(6)(a) of the regulations is amended by deleting the amount "$125" and substituting the amount "$290".

             (2)  Paragraph 23(6)(b) of the regulations is amended by deleting the amount "$175" and substituting the amount "$350".

 

      12. Subsection 50(1) of the regulations is amended by deleting the word and number "or 14" wherever they appear.

Commencement

      13. These regulations come into force on September 1, 2025.
