Rules of the Supreme Court, 1986 (Amendment)
under the
Judicature Act

Under the authority of section 55 of the Judicature Act, the Rules Committee of the Supreme Court makes the following Rules.

        1. (1) Rule 4.02(1)(d) of the Rules of the Supreme Court, 1986 is amended and the following substituted:

             (d)  all original signatures on the document shall be in ink.

             (2)  The rules are amended by adding immediately after Rule 4.02(1) the following:

         (1.1)  In this rule "electronic signature" means electronic information that a person creates or adopts in order to sign a document and that is in, attached to or associated with the document.

         (1.2)  Notwithstanding paragraph (1)(d), where a document has been sworn or affirmed through use of audio-visual technology in accordance with the Commissioners for Oaths Act, that document may be signed with an electronic signature.

 

        2. Rule 56.03(1) of the rules is repealed and the following substituted:

 

56.03 (1) A grant of administration must be made to a person resident within the province in preference to a person having equal right residing outside the province, unless a judge order otherwise.

 

        3. The rules are amended by repealing and substituting the following forms:

             (a)  F16.04B;

             (b)  F16.04C;

             (c)  F25.03A;

             (d)  F34.02A; and

             (e)  F35.03A.

Commencement

        4. These regulations come into force on August 22, 2025.
