Offshore Oil Royalty Regulations (Amendment)
under the
Petroleum and Natural Gas Act
(O.C. 2026-057)

Under the authority of section 39 of the Petroleum and Natural Gas Act, the Lieutenant-Governor in Council makes the following regulations.

        1. Subsection 76(1) of the Offshore Oil Royalty Regulations is amended by repealing the description of "B" and substituting the following:

                      B = days on which a tanker is carrying oil; and

 

        2. Section 85 of the regulations is repealed and the following substituted:

Appeal

      85. (1) A person aggrieved by a decision of the minister under these regulations may, within 120 days of the decision, appeal, on a question of law or on a question of mixed law and fact, to the Supreme Court and the decision of the Supreme Court is final.

             (2)  An appeal may be taken from a decision of a judge of the Supreme Court to the Court of Appeal on a point of law raised upon the hearing of the appeal by the judge of the Supreme Court.

             (3)  A judge may make an order as to costs for or against the appellant or the Crown and may fix the amount of those costs.

             (4)  The filing of an appeal under this section shall not affect the decision appealed from and the decision shall remain in force pending the outcome of the appeal.

 

        3. Section 86 of the regulations is repealed.
