Pension Benefits Act Regulations (Amendment)

Pension Benefits Act, 1997

Under the authority of section 78 of the Pension Benefits Act, 1997, the Lieutenant-Governor in Council makes the following regulations.

        1. (1) Paragraph 2(1)(v) of the Pension Benefits Act Regulations is repealed.

             (2)  Paragraph 2(1)(y) of the regulations is repealed.

        2. (1) Subsection 15(2) of the regulations is repealed and the following substituted:

             (2)  The transfer value of a pension benefit as of a given date shall be determined by multiplying the commuted value, as determined in accordance with section 14, by the lesser of 1.00 and the most recently determined solvency ratio.

             (2)  Subsection 15(4) of the regulations is amended by deleting the words and number "equal to 1.00" and substituting the words and number "equal to or greater than 1.00".
