Under the authority of section 70 of the Memorial University Act, the Lieutenant-Governor in Council makes the following regulations.

Short title

        1. These regulations may be cited as the Memorial University Regulations.

Definitions

        2. In these regulations,

             (a)  "Act" means Memorial University Act;

             (b)  "member" means a member of the Canadian Armed Forces or a member of the Royal Canadian Mounted Police;

             (c)  "member of the Canadian Armed Forces" means an active, retired, disabled or deceased member of the Canadian Armed Forces;

             (d)  "member of the Royal Canadian Mounted Police" means an active, retired, disabled or deceased sworn federal officer of the Royal Canadian Mounted Police; and                  

             (e)  "relocation directive" means the Canadian Armed Forces Relocation Directive or the Royal Canadian Mounted Police Relocation Directive.          

Newfoundland and Labrador resident

        3. A person who meets one or more of the requirements prescribed in paragraphs 69(2)(a) or (b) of the Act or one of the following requirements is a "Newfoundland and Labrador resident":

             (a)  the person meets both of the following requirements:

                      (i)  the person is the child or spouse of a member and the member meets all the following requirements:

                            (A)  the member was born in the province,

                            (B)  the member lived in the province for at least 10 consecutive years,

                            (C)  at the time of enrollment in the Canadian Armed Forces or the Royal Canadian Mounted Police, the member lived in the province,

                            (D)  where the member has declared an intended place of residence under a relocation directive, the member has declared the province as the intended place of residence, and

                            (E)  where the member is retired or released from the Canadian Armed Forces or the Royal Canadian Mounted Police, the member lives in the province, and

                     (ii)  the person lived in the province for at least

                            (A)  12 consecutive months immediately before the date of application to the faculty or school, and

                            (B)  one additional 12 consecutive month period at any time before the period referred to in clause A; or

             (b)  the person is a member and meets all the following requirements:

                      (i)  the person was born in the province,

                     (ii)  the person lived in the province for at least 10 consecutive years,

                    (iii)  at the time of enrollment in the Canadian Armed Forces or the Royal Canadian Mounted Police the person lived in the province,

                    (iv)  where the person has declared an intended place of residence under a relocation directive, the person has declared the province as the intended place of residence, and

                     (v)  where the person is retired or released from the Canadian Armed Forces or the Royal Canadian Mounted Police, the person lives in the province.
