Under the authority of section 65 of the Occupational Health and Safety Act, the Lieutenant-Governor in Council makes the following regulations.

        1. Section 70 of the Occupational Health and Safety Regulations, 2012 is repealed and the following substituted:

Definitions

      70. In this Part

             (a)  "fit test" means a quantitative or qualitative test performed in accordance with procedures in CSA Standard CAN/CSA-Z94.4 "Selection, Use, and Care of Respirators" to evaluate the fit of a respirator on an individual;

             (b)  "flame resistant", in reference to clothing, means made of a material that, due to its inherent properties or as a result of treatment by a flame retardant, slows, terminates or prevents flaming combustion; and

             (c)  "user seal check" means a negative or positive pressure check of a respirator's seal, performed by the user of the respirator in accordance with the respirator manufacturer's instructions.

 

        2. Section 71 of the regulations is repealed and the following substituted:

Selection, use and maintenance

      71. Personal protective equipment shall be

             (a)  selected and used in accordance with recognized standards and provide effective protection;

             (b)  properly fitted so as not to create a hazard to the wearer;

             (c)  compatible so that one item of personal protective equipment does not make another item ineffective; and

             (d)  maintained in good working order and in sanitary condition.

 

        3. Section 81 of the regulations is repealed and the following substituted:

High visibility safety apparel

      81. A worker whose duties are regularly performed in areas and under circumstances where the worker is exposed to the danger of moving vehicles or heavy equipment shall wear high visibility safety apparel that meets the requirements set out in CSA Standard Z96 "High-Visibility Safety Apparel".

 

        4. (1) Subsection 85(2) of the regulations is repealed and the following substituted:

             (2)  The equipment referred to in subsection (1) shall

             (a)  be certified by the National Institute for Occupational Safety and Health; or

             (b)  meet the requirements set out in CSA Standard Z94.4.1 "Performance of Filtering Respirators".

             (2)  Subsection 85(7) of the regulations is repealed and the following substituted:

             (7)  Where a tight-fitting respirator is used by an employee, the employer shall ensure that

             (a)  a fit test is performed to ensure that

                      (i)  the correct style and size respirator is selected for the employee, and

                     (ii)  the respirator forms a secure seal against the employee's face; and

             (b)  the employee performs a user seal check before each use.
