AN ACT TO REMOVE ANOMALIES AND ERRORS IN THE STATUTE LAW

Be it enacted by the Lieutenant-Governor and House of Assembly in Legislative Session convened, as follows:


Short title

1. This Act may be cited as the Attorney General Statutes Amendment Act, 1992.

2. Section 56 of the Automobile Insurance Act is amended by deleting the word "March" and substituting the word "May" and by deleting the word "calendar" and substituting the word "fiscal".

3. Section 45 of the Child Welfare Act is amended by renumbering it as subsection 45(1) and by adding immediately after subsection (1) the following:

(2) After July 7, 1988, where the hearing of an appeal from the Unified Family Court to the Trial Division under this section is pending, the appeal may be transferred to the Court of Appeal and may be heard in that court.

4. Subsection 30(3) of the Colleges Act, 1991 is repealed and the following substituted:

(3) Regulations made under subsection (1) or (2) may be made with retroactive effect.

5. Subsection 14(1) of the Forestry Act is amended by deleting the word "and" and substituting the word "or".

6. (1) Subsection 106(30) of the Highway Traffic Act is amended by adding immediately after the word "section" where it last occurs, the words "and no other vehicle shall stop or park at a bus stop".

(2) The reference to subsection 106(30) in the Schedule of the Act is amended by adding after the words "Bus Stop" the words "or vehicle stopping or parking at a bus stop".

7. Subsection 19(2) of the Hospitals Act is amended by striking out the word "bank" and substituting the words "financial institution authorized by law to accept deposits".

8. Subsection 9.1(7) of the Labour Relations Act is amended by deleting the words "a dispute resolution mechanism" and by substituting the words "an individual to act as jurisdictional umpire".

1992 c18

9. (1) Section 11 of the Liquor Control (Amendment) Act and Liquor Corporation (Amendment) Act, 1992 c18, is amended by striking out the figure "26" and substituting the figure "32".

(2) This section shall be considered to have come into force on April 1, 1992.

10. (1) Subsection 11(2) of the Liquor Corporation Act is repealed.

1985 c28

(2) Section 13 of The Liquor Corporation Act, 1973 (Amendment) Act, 1985 c28, is repealed.

(3) Subsection (2) shall be considered to have come into force on December 10, 1985.

1991 c15

11. (1) Section 26 of the Provincial Court Act, 1991 is amended by adding immediately after subsection (3) the following:

(4) A person appointed as a clerk is by virtue of his or her office, a justice of the peace.

(2) Subsection (1) shall be considered to have come into force on October 16, 1991.

12. (1) Section 32 of the Public Service Collective Bargaining Act is amended by adding the following immediately after subsection (4):

(5) Each party who is required to name a member of the adjudication board shall pay the remuneration and expenses of that member and the parties shall pay equally the remuneration and expenses of the chairperson.

(2) Section 48 of the Act is amended by adding the figure and comma "88(1)," immediately after the figure and comma "22,".

13. (1) Subsection 32(4) of the Public Service Pensions Act, 1991 is amended by deleting the word "providing" and substituting the word "provides".

(2) Subsection 32(5) of the Act is repealed and the following substituted:

(5) Where a marriage contract, separation agreement or court order provides for a division of a pension, including a division of contributions, the marriage contract, separation agreement or court order shall apply only in relation to benefits or contributions accrued between the date of marriage and the date of marriage breakdown.

(3) This section shall be considered to have come into force on September 1, 1991.

14. Paragraph 2 of Form C of the Schedule to the St. John's Municipal Elections Act is amended by deleting the number and words "12 months immediately preceding the enumeration of electors" and substituting the number and words "30 days immediately preceding election day".

15. Section 7 of the Securities Act is amended by adding immediately after the word "Securities" where it first occurs the words "or a person designated by the minister to perform the duties of the Director of Securities".

1991 c39

16. Paragraph 9(1)(f) of the Sheriff's Act, 1991 is amended by inserting after the word and comma "child," the words and commas "brother, sister,".

RSN 1990 cS-25 as amended

17. (1) The Status of Women Advisory Council Act is amended by deleting the words "director of administration" wherever they occur and substituting the words "executive director".

(2) Section 13.1 of the Act is repealed and the following substituted:

Pensions

13.1 The Public Service Pensions Act, 1991 shall apply to all full time permanent employees of the advisory council.

18. (1) Subparagraph 13(2)(a)(i) of the Teachers' Pensions Act is amended by adding immediately before the word "less" the word "not".

(2) Subsection (1) shall be considered to have come into force on January 1, 1992.
