AN ACT TO AMEND THE WORKERS'
COMPENSATION ACT

Benefits to be considered

Be it enacted by the Lieutenant-Governor and House of Assembly in Legislative Session convened, as follows:

1. Section 81 of the Workers' Compensation Act is amended by adding the following immediately after subsection (3):

(4) Notwithstanding subsection (3), where the commission has, prior to January 1, 1993, considered Canada Pension Plan benefits under that subsection in calculating compensation to be paid to a worker, the commission shall not alter the manner in which that worker's Canada Pension Plan benefits are considered except upon a recurrence of the worker's injury.
