AN ACT TO AMEND THE PUBLIC SERVICE
PENSIONS ACT, 1991 AND THE UNIFORMED SERVICES PENSIONS ACT, 1991

Be it enacted by the Lieutenant-Governor and House of Assembly in Legislative Session convened, as follows:

PUBLIC SERVICE PENSIONS ACT, 1991


1991 c12 as amended

1. Section 16 of the Public Service Pensions Act, 1991 is amended by adding immediately after subsection (4) the following:

(4.1) Notwithstanding subsection 16(1), where, during the period an employee is on sick leave,

(a) the employee's employment is terminated by reason of redundancy;

(b) the employee has not used up all his or her sick leave benefits; and

(c) the employee meets the requirements of this section,

the employee shall be retired under the pension plan from the date the employee's employment is terminated.

UNIFORMED SERVICES PENSIONS ACT, 1991

2. Section 18 of the Uniformed Services Pensions Act, 1991 is amended by adding immediately after subsection (1) the following:

(1.1) Notwithstanding subsection 18(1), where, during the period an employee is on sick leave,

(a) the employee's employment is terminated by reason of redundancy;

(b) the employee has not used up all his or her sick leave benefits; and

(c) the employee meets the requirements of this section,

the employee shall be retired under the pension plan from the date the employee's employment is terminated.
