AN ACT TO AMEND THE JUDICATURE ACT

Powers of the chief justices

Be it enacted by the Lieutenant-Governor and House of Assembly in Legislative Session convened, as follows:

1. Section 49 of the Judicature Act is repealed and the following substituted:

Powers of the chief justices

49. (1) Where there is a vacancy in the office of, or the Chief Justice of Newfoundland or the Chief Justice of the Trial Division,

(a) is absent from the province;

(b) is unable to act; or

(c) requests it,

his or her powers shall be exercised by the next senior judge of the respective court who is able to act in the place of the Chief Justice of Newfoundland, or the Chief Justice of the Trial Division.
