Video Lottery Regulations
under the
Lotteries Act
(O.C. 96-164)

Under the authority of section 5 of the Lotteries Act and the Subordinate Legislation Revision and Consolidation Act , the Lieutenant-Governor in Council makes the following regulations.

Short title

        1. These regulations may be cited as the Video Lottery Regulations.

Definitions

        2. In these regulations

             (a)  "Act" means the Lotteries Act;

             (b)  "corporation" means the Atlantic Lottery Corporation;

             (c)  "site" means premises which are accessed or used by a person playing a video lottery terminal;

             (d)  "siteholder" means an occupier of a site;

             (e)  "video lottery" means a video lottery scheme or enterprise using one or more video lottery terminals;

              (f)  "video lottery game" means a transaction or operation which allows a person to play electronic video games in which, by chance, a person may receive free games or credits which can be redeemed for money; and

             (g)  "video lottery terminal" means a machine or device which allows a person to play one or more electronic games of chance.

Operation to be approved

        3. (1) A person shall not operate a video lottery in the province unless it has been approved by the corporation.

             (2)  In determining whether to approve a video lottery, the corporation may assess the suitability of the siteholder, taking into account the following factors:

             (a)  business associations;

             (b)  reputation in the community;

             (c)  financial statements;

             (d)  relationship to other siteholders;

             (e)  previous or existing participation in a video lottery;

              (f)  residency; and

             (g)  another matter considered appropriate by the corporation.

Approval and official decal required

        4. A person shall not operate a video lottery game or a video lottery terminal unless it has been approved by the corporation and the video lottery terminal has affixed to it the official decal of the corporation.

Site to be approved

        5. (1) A person shall not use a site for the operation of a video lottery unless the site has been approved by the corporation.

             (2)  In considering whether to approve a site for the operation of a video lottery, the corporation may consider the following factors:

             (a)  the nature of the business;

             (b)  the hours of operation;

             (c)  security;

             (d)  geographic location and physical location;

             (e)  the estimated revenues from the proposed video lottery operation on the proposed site; and

              (f)  those other factors as the corporation may feel is relevant or the commission may direct.

Approval to manufacture

        6. A person shall not manufacture or supply video lottery terminals in the province unless approval has been given by the corporation.

Video lottery terminals

        7. (1) Video lottery terminals may be installed directly by the corporation on approved sites under agreements with the siteholders.

             (2)  There shall be no more than 5 video lottery terminals on a site.

Requirements

        8. A person shall not operate a video lottery terminal that does not comply with the following requirements:

             (a)  all money accepted shall be divided into credits denominated in $0.25, $0.10 or $0.05 values;

             (b)  only wagers of one credit shall be accepted;

             (c)  a player shall not be exposed, at any one play, to the chance of losing credits of a total value exceeding $2.50;

             (d)  a player shall be permitted to withdraw any accumulated or unused credits for payment or reimbursement;

             (e)  prizes for any one wager shall not exceed $500;

              (f)  the terminal shall not dispense cash prizes;

             (g)  the terminal shall be programmed so that, over time, prizes shall not be less than 80% and not more than 96% of the money accepted; and

             (h)  tickets shall be issued to indicate the value of a prize or credit.

Ticket value to be paid

        9. A siteholder shall, on presentation of a ticket dispensed by an approved gaming device on the site, pay or reimburse the value of the accumulated or unused credits stated on the ticket.

Advertisement

     10. A person shall not advertise or promote a video lottery or the availability at a site of a video lottery terminal unless the corporation has given its prior approval.

Credit prohibited

     11. A siteholder shall not grant credit or negotiate cheques to enable a person to play a video lottery game.

Age of player

     12. A siteholder shall not permit a person under the age of 19 to play a video lottery terminal.

Prohibition

     13. (1) A siteholder shall not remove or replace video lottery terminals situated at the siteholder's premises without the prior consent of the corporation.

             (2)  A siteholder shall not manipulate or allow another person to manipulate a video lottery terminal so as to influence the outcome or pay?off of a video lottery game.

Repeal

      14. The Video Lottery Regulations, Newfoundland Regulation 50/92, are repealed.
