Short title

        1. These regulations may be cited as the Boiler, Pressure Vessel and Compressed Gas Regulations.

PART I
DEFINITIONS AND APPLICATION

Definitions

        2. In these regulations

             (a)  "Act" means the Public Safety Act ;

             (b)  "approved course" means a course approved by the chief inspector to qualify a candidate for an examination;

             (c)  "ASME" means the American Society of Mechanical Engineers;

             (d)  "assistant shift engineer" means a power engineer who takes charge of a section of a registered pressure plant under the supervision of a shift engineer;

             (e)  "CGA " means the Canadian Gas Association;

              (f)  "certificate of competency" means a certificate which has been validated;

             (g)  "chief inspector" means the chief inspector of boiler, pressure vessel and compressed gas systems;

             (h)  "chief operator" means an operator who is responsible for and supervises the operation of a registered compressed gas or refrigeration plant;

              (i)  "chief power engineer" means a power engineer who is responsible for and supervises the operation of a registered pressure plant;

              (j)  "combined pressure plant" means a plant in which there is a combination of a power boiler, a heating boiler, a refrigeration system or compressed gas system;

             (k)  "compressed gas" means any gas contained under pressure whether in a liquid, vapour or dissolved state;

              (l)  "compressed gas plant" means a plant in which one or more compressed gas systems other than refrigeration are installed;

            (m)  "continuous supervision" means, in relation to a registered pressure plant, that a power engineer or operator of the class prescribed by these regulations is in attendance at all times while the plant is in operation;

             (n)  "contractor" means a person who installs a pressure system;

             (o)  "CRN " means Canadian Registration Number in accordance with the CSA B51 Code;

             (p)  "CSA " means the Canadian Standards Association;

             (q)  "examiner" means an officer authorized by the chief inspector to conduct or supervise examinations;

              (r)  "gas" means natural gas, manufactured gas, or any material which is composed predominantly of any of the following hydrocarbons or mixtures:

                      (i)  propane,

                     (ii)  propylene,

                    (iii)  butane, and

                    (iv)  butylenes;

             (s)  "government service centre" means the Government Service Centre;

              (t)  "guarded" means that every boiler or compressor is provided with those devices in good operating condition that will ensure the boiler or compressor is operated safely notwithstanding that the power engineer or operator in charge of the plant may be absent from the boiler room or compressor room;

             (u)  "heating plant" means

                      (i)  one or more boilers in which steam or vapour may be generated at a pressure not exceeding 103 kilopascals,

                     (ii)  one or more boilers in which water or other liquid may be generated at a pressure not exceeding 1,100 kilopascals and a temperature not exceeding 121° C at or near the outlet of the boiler, or

                    (iii)  any combination of subparagraph (i) or (ii) and the pressure vessels, pressure piping system, machinery and ancillary equipment used in that connection;

             (v)  "hot water tank" means a pressure vessel used to contain hot water at a pressure exceeding 103 kilopascals and having a diameter of more than 610 millimetres but does not include a hot water tank used in private residences;

            (w)  "hydropneumatic tank" means a pressure vessel having a diameter of more than 610 millimetres and containing both liquid and air at a pressure exceeding 103 kilopascals;

             (x)  "manufacturer" means one or more persons whether incorporated or not, responsible for the fabrication, completely or in part, of any boiler, pressure vessel, pressure piping system or fitting;

             (y)  "minimum supervision" means a guarded plant is under the care of a power engineer or operator of the class prescribed by these regulations who is responsible for the safe operation and maintenance of the plant;

             (z)  "NBBI" means the National Board of Boiler and Pressure Vessel Inspectors;

           (aa)  "operating experience" means the experience obtained through actual attendance in the operation of a registered pressure plant;

          (bb)  "operator" means a person holding a certificate of competency who operates a refrigeration plant or compressed gas plant;

           (cc)  "periodic supervision" means that a power engineer or operator, of the class prescribed by these regulations, is on the premises at all times while the plant is in operation and any buildings it services are occupied;

          (dd)  "power engineer" means a person holding a certificate of competency;

           (ee)  "power plant" means

                      (i)  one or more boilers in which steam or other vapour is generated at more than 103 kilopascals,

                     (ii)  one or more boilers containing liquid and having either a working pressure exceeding 1,100 kilopascals or a temperature exceeding 121° C or both, or

                    (iii)  any combination of subparagraphs (i) and (ii) and the pressure vessels, pressure piping system, machinery and ancillary equipment used in that connection;

            (ff)  "pressure piping" means

                      (i)  steam piping of any size or pressure,

                     (ii)  water piping larger than 20 millimetres nominal pipe size to carry water at more than 66° C,

                    (iii)  piping to carry refrigerants, anhydrous ammonia, propane and similar gases,

                    (iv)  air or other inert gas piping larger than 20 millimetres nominal pipe size or at a pressure greater than 1,750 kilopascals,

                     (v)  oil piping larger than 20 millimetres nominal pipe size to carry oil at more than 66° C,

                    (vi)  piping systems used for the movement of non-flammable medical gases, and

                   (vii)  any other piping used in connection with or as part of a pressure system and classified as pressure piping by the chief inspector;

          (gg)  "pressure welder" means a person holding a valid performance qualification record for welding or brazing as issued by the government service centre;

          (hh)  "pressure welding" means welding or brazing as approved by these regulations on any pressure system under the Act;

             (ii)  "pressure" means pressure in kilopascals as measured by a pressure gauge, directly connected to the equipment of which it measures the pressure;

             (jj)  "refrigerant" means a fluid that absorbs heat at a low temperature and pressure, with a change of state, and rejects it at a higher temperature and pressure;

           (kk)  "refrigeration plant" means a pressure plant in which one or more refrigeration systems are installed;

             (ll)  "registered" means recorded by the government service centre;

         (mm)  "shift engineer" means a power engineer who has charge of and operates a registered pressure plant under the direction and supervision of the chief power engineer;

          (nn)  "shift operator" means an operator who has charge of and operates a registered pressure plant under the direction and supervision of a chief power engineer or chief operator;

          (oo)  "shop inspection" means the inspection of a boiler, pressure vessel, fitting or pressure piping system during and upon completion of fabrication and includes a review for the purpose of evaluating or auditing an owner's quality program;

          (pp)  "symbol" means the letters or figures or a combination issued to a pressure welder for stamping his or her work;

          (qq)  "validated" means validated by the chief inspector;

            (rr)  "welding procedure" means a procedure compiled by an owner outlining in detail the manner in which any welding or brazing is to be performed and subject to registration by the government service centre; and

           (ss)  "welding tests" means tests pertaining to procedure and pressure welder qualification acceptable to the chief inspector.

Application

        3. (1) These regulations apply to all steam and hot water boilers, pressure vessels, heat exchangers, air receivers, pressure plants, pressure piping systems, compressed gas systems and other pressure vessels or fittings referred to in the Act or defined in these regulations and to all power engineers, refrigeration and compressor operators, pressure welders, gas personnel and medical gas installers.

             (2)  Subject to subsection (3), these regulations do not apply to

             (a)  boilers or pressure vessels subject to inspection under the Canada Shipping Act (Canada );

             (b)  a person, other than a power engineer or operator, engaged in the commissioning or testing of a pressure plant;

             (c)  boilers or pressure vessels subject to inspection by the Board of Transport Commissioners for Canada ;

             (d)  a boiler that has a capacity of 60 kilowatts or less other than a miniature boiler;

             (e)  a boiler that is connected to a hot water heating system in which the water is heated and circulated with no intervening valves between the boiler and the expansion tank that is fully vented to the atmosphere;

              (f)  a pressure system used solely for heating purposes in a private dwelling;

             (g)  a pressure vessel other than for steam, operated with the relief valve set at 103 kilopascals or less;

             (h)  a pressure vessel that has an internal diameter of 610 millimetres or less and that contains both liquid and air used exclusively for hydraulic purposes at atmospheric temperatures or used to serve as a cushion in a water pumping or heating system;

              (i)  a pressure vessel having an internal diameter of 610 millimetres or less used for the storage of hot water for domestic purposes;

              (j)  a pressure vessel used for the storage of water or oil when the temperature of the water or oil is less than 66° C; and

             (k)  a refrigerating system that has a motive rating of 10.5 kilowatts or less.

             (3)  Pressure vessels of 50 litres or less in capacity in the following categories are subject to all requirements of the Act and regulations:

             (a)  steam jacketed sterilizers;

             (b)  autoclaves; and

             (c)  steam jacketed kettles.

        4. The following codes and standards are adopted under section 34 of the Act and form part of these regulations:

             (a)  CSA B51 Boiler, Pressure Vessel and Pressure Piping Code;

             (b)  CSA B52 Mechanical Refrigeration Code;

             (c)  CAN/CSA B139 Installation Code for Oil Burning Equipment;

             (d)  CSA Z7396.1 Medical Gas Pipeline Systems;

             (e)  CAN/CSA -B149.1 Natural Gas and Propane Installation Code;

              (f)  CAN/CSA -B149.2 Propane Storage and Handling Code;

             (g)  CAN/CSA -B149.3 Code for the Field Approval of Fuel-Related Components on Appliances and Equipment;

Chief inspector

        5. The chief inspector may for the purpose of these regulations validate certificates of competency that are issued by another department of government and perform those other duties as may be necessary for the administration of the regulations.

General requirements

        7. (1) A power engineer holding a valid certificate of competency shall maintain it in the registered plant.

             (2)  Nothing in these regulations shall be construed to permit any person to use a name, title or description that may lead to the belief that the person is qualified or entitled to practice professional engineering as defined in theEngineers and Geoscientists Act .

             (3)  The owner of a registered plant shall not require or permit a power engineer or operator in charge of the plant to perform a duty where an inspector is of the opinion that the performance of that duty may endanger the safety of the plant.

             (4)  No owner shall permit a person to operate or take charge of a registered plant who is not the holder of a certificate of competency validated under this section of the class required for that plant by these regulations.

             (5)  The holder of a power engineer's certificate of competency under these regulations may operate, repair and give advice on all things pertaining to any pressure plant of which the certificate gives him or her charge under the Act only where the certificate of competency is validated by the chief inspector.

             (6)  Where in relation to performing the functions of a power engineer or operator a person is required to hold a certificate under the Act or regulations that person shall not be required by a municipality or otherwise to hold any other certificate or licence for the performing of those functions.

Cancellation or suspension of certificates of competency

        8. The chief inspector may cancel or suspend the validation of a certificate of competency if the chief inspector is satisfied that the holder of the certificate

             (a)  is incompetent or negligent in the discharge of duties;

             (b)  has obtained the certificate of competency through misrepresentation or fraud;

             (c)  allows or has allowed another person to operate under his or her certificate of competency;

             (d)  has attempted, by impersonating another person, to secure falsely a certificate of competency for another person; or

             (e)  verifies the application form of a candidate for examination without personally knowing the truth of the written statements of operating experience included.

Temporary assignment

        9. (1) Where an owner proposes to temporarily assign a person in accordance with subsection (2), the owner shall give the chief inspector written notification in advance of the temporary assignment and shall certify that the services of the holder of a certificate of competency as required by the regulations cannot be obtained.

             (2)  Where a power engineer or operator is absent from the registered plant, the employer may assign only a person with a certificate not more than one grade lower than the certificate that is required for the plant in order to allow

             (a)  a shift engineer of a plant to act as chief power engineer of the same plant;

             (b)  an assistant shift engineer to act as a shift engineer in the same plant; or

             (c)  a shift operator of a plant to act as a chief operator of the same plant.

             (3)  The duration of an assignment under subsection (1) or (2) shall not be longer than 6 months.

             (4)  An owner shall certify that a person temporarily assigned to act as chief power engineer, shift engineer or chief operator is capable of acting in the capacity assigned.

Engineers duties

      10. (1) The owner shall designate a chief power engineer or chief operator, of the class prescribed by these regulations, for each pressure plant registered under the Act and the regulations.

             (2)  In addition to powers and duties set out in the Act and the Occupational Analysis Series Power Engineer as published by Employment and Immigration Canada, a chief power engineer or chief operator shall

             (a)  take all measures necessary to maintain the safe operation of the pressure plant;

             (b)  ensure that the pressure plant is operated by a sufficient number of engineers or operators who hold validated certificates required by the Act and the regulations and who have been trained to operate the plant in a competent manner; and

             (c)  ensure that a copy of the Act and the regulations are available to all staff operating under the authority of the Act.

Scope of employment

      11. (1) The holder of a validated Power Engineer's Certificate of Competency First Class may be employed as a chief power engineer or shift engineer of any registered pressure plant of unlimited kilowatt capacity.

             (2)  The holder of a validated Power Engineer's Certificate of Competency Second Class may be employed as

             (a)  a chief power engineer of

                      (i)  a registered power plant not exceeding 24,000 kilowatts, or

                     (ii)  a registered combined pressure plant not exceeding 48,000 kilowatts where the power boiler capacity accounts for not more than 24,000 kilowatts; or

             (b)  a shift engineer of a registered pressure plant of unlimited kilowatt rating.

             (3)  The holder of a validated Power Engineer's Certificate of Competency Third Class may be employed as

             (a)  a chief power engineer of

                      (i)  a registered power plant not exceeding 12,000 kilowatts,

                     (ii)  a registered combined pressure plant not exceeding 24,000 kilowatts where the power boiler capacity accounts for not more than 12,000 kilowatts,

                    (iii)  a heating plant of unlimited kilowatt capacity,

                    (iv)  a registered refrigeration plant of unlimited kilowatt capacity, or

                     (v)  a registered compressed gas plant of unlimited kilowatt capacity; or

             (b)  a shift engineer of

                      (i)  a registered power plant not exceeding 24,000 kilowatts,

                     (ii)  a registered combined pressure plant not exceeding 48,000 kilowatts where power boiler capacity accounts for not more than 24,000 kilowatts, or

                    (iii)  a registered heating plant of unlimited kilowatt capacity; or

             (c)  an assistant shift engineer in a registered pressure plant of unlimited kilowatt capacity.

             (4)  The holder of a validated Power Engineer's Certificate of Competency Fourth Class may be employed as

             (a)  a chief power engineer of

                      (i)  a registered power plant not exceeding 3,600 kilowatts,

                     (ii)  a registered combined pressure plant not exceeding 7,200 kilowatts where the power boiler capacity accounts for not more than 3,600 kilowatts and refrigeration not more than 450 kilowatts,

                    (iii)  a registered heating plant not exceeding 12,000 kilowatts,

                    (iv)  a registered refrigeration plant not exceeding 450 kilowatts or 750 kilowatts when a plant uses only Group A1 refrigerants, or

                     (v)  a registered compressed gas plant of unlimited kilowatt capacity; or

             (b)  a shift engineer of

                      (i)  a registered power plant not exceeding 12,000 kilowatts,

                     (ii)  a registered combined pressure plant not exceeding 24,000 kilowatts where the power boiler capacity accounts for not more than 12,000 kilowatts,

                    (iii)  a registered heating plant not exceeding 24,000 kilowatts capacity,

                    (iv)  a registered refrigeration plant of unlimited kilowatt capacity, or

                     (v)  a registered compressed gas plant of unlimited kilowatt capacity, or

             (c)  an assistant shift engineer of

                      (i)  a registered power plant not exceeding 24,000 kilowatts, or

                     (ii)  a registered combined pressure plant not exceeding 36,000 kilowatts, where the power boiler capacity accounts for not more than 24,000 kilowatts.

             (5)  The holder of a validated Compressor Operator's Certificate of Competency may be employed as chief operator or shift operator to take charge of and to operate a compressed gas pressure plant of unlimited kilowatt capacity.

             (6)  The holder of a validated Refrigeration Operator Grade "A" Certificate of Competency may be employed as chief operator or shift operator to take charge of and to operate a registered refrigeration plant of unlimited capacity.

             (7)  The holder of a validated Refrigeration Operator Grade "B" Certificate of Competency may be employed as

             (a)  a chief operator of a registered refrigeration plant not exceeding 450 kilowatts or 750 kilowatts when a plant uses only Group A1 refrigerants; or

             (b)  a shift operator of a registered refrigeration plant of unlimited kilowatt capacity.

PART III
PRESSURE PLANT REGISTRATION

Registration of plants

      12. (1) The owner of a pressure plant as classified in subsection (2) shall, before operating it, register the kilowatt rating of that plant and shall complete an application in the form provided by the chief inspector for that registration.

             (2)  Registered plants classification and certificates of plant registration in the form provided by the chief inspector may be issued in respect of the following:

             (a)  power plant;

             (b)  heating plant;

             (c)  refrigeration plant;

             (d)  compressed gas plant; and

             (e)  combined pressure plant.

             (3)  Continuous supervision shall be provided for all registered pressure plants except as provided for in section 23.

Calculation of kilowatt rating

      13. The total kilowatt rating of a registered

             (a)  power plant is the sum of the kilowatt rating of the power boilers when that sum exceeds 600 kilowatts;

             (b)  heating plant is the sum of the kilowatt rating of the heating boilers when that sum exceeds 1,800 kilowatts;

             (c)  refrigeration plant is the sum of the kilowatt rating of the refrigeration systems when the sum exceeds 75 kilowatts or 450 kilowatts when a plant uses only Group A1 refrigerants;

             (d)  compressed gas plant is the sum of the kilowatt rating of the compressed gas systems when that sum exceeds 250 kilowatts; and

             (e)  combined pressure plant is the sum of the total kilowatt ratings calculated under paragraphs (a), (b), (c) and (d).

Record of certificate holders at plant

      14. The owner of a plant shall, when applying for a certificate of plant registration for a pressure plant, advise the chief inspector of the name and index number, class and year of issue of the certificate of competency held by each power engineer and operator who shall be engaged in the operation of that plant and shall from then on inform the chief inspector of any changes of staff.

Contents of registration certificate

      15. A certificate of plant registration shall show

             (a)  the registration number;

             (b)  the name of the owner of the plant;

             (c)  the classification and kilowatt rating of the plant; and

             (d)  the classes of power engineers and operators required for the operation of the plant.

Change in owner or kilowatt rating

      16. When the ownership or classification of a registered plant is changed or the kilowatt rating is increased or decreased sufficiently to change the classification of power engineers required for its operation, the certificate of plant registration in relation to the plant is no longer valid and the owner shall, within one month after the change, notify the chief inspector of the change and upon payment of the registration fee by the owner, a new certificate of plant registration shall be issued in accordance with the new ownership, classification or kilowatt rating of the plant.

Certificate to be displayed

      17. The owner of a plant shall conspicuously display the certificate of registration in the engine room, compressor room or boiler room of the plant.

Same premises

      18. Where 2 or more plants of an owner are located on the same premises, plants shall, unless the chief inspector determines otherwise, be registered as one plant.

Log book

      19. (1) The owner shall provide a log book for use in the plant and the chief power engineer or chief operator shall ensure that the person in charge of each shift records in the log book

             (a)  the date, the number and designation of the shift and the name of the person in charge;

             (b)  any change from normal operating procedure and the time of the change;

             (c)  any special instructions given to achieve the change referred to in paragraph (b) and the name of the person who gave the instruction;

             (d)  any unusual or abnormal condition observed in the plant and the time of the observation;

             (e)  repairs to any part of the plant and the time repairs were commenced and if completed on the shift, the time of completion; and

              (f)  the time of the beginning and end of the shift.

             (2)  An inspector

             (a)  has the right to examine a log book and give instructions relating to it that the inspector thinks appropriate; and

             (b)  may seize a log book as evidence in the case of an investigation.

             (3)  The owner shall ensure that the log book is kept accessible in the plant for at least one year after its last entry, and shall produce the log book for examination upon request of the inspector.

Kilowatt rating of non-electric boiler

      20. (1) The kilowatt rating of a boiler other than an electric boiler shall be

             (a)  the boiler horsepower as calculated by the manufacturer multiplied by 9.81; or

             (b)  the maximum heat input of the boiler as measured in kilojoules divided by 3,600.

             (2)  Where an owner wishes to reduce the kilowatt rating of a boiler, the owner may apply to the chief inspector for special ratings based on the controlled fuel input where the heat value of the fuel is based on the commercial ratings in kilojoules.

      21. The kilowatt rating of an electric boiler shall be the maximum number of kilowatts supplied to the boiler per hour as determined by its manufacturer for its normal continuous operation.

      22. (1) The kilowatt rating of a prime mover other than an electric motor or internal combustion engine is the maximum brake horsepower as determined by its manufacturer for normal continuous operation multiplied by.746.

             (2)  The kilowatt rating of an electric motor is

             (a)  the maximum kilowatt rating of the motor as determined by its manufacturer; or

             (b)  the maximum brake horsepower as determined by its manufacturer multiplied by.746.

             (3)  The kilowatt rating of an internal combustion engine is

             (a)  the maximum kilowatt rating of the engine as determined by the engine manufacturer for its normal continuous operation; or

             (b)  the maximum brake horsepower as determined by the engine manufacturer for its normal continuous operation multiplied by.746.

Guarded plants

      23. (1) Notwithstanding subsection 12(3), where the owner of a guarded plant complies with the requirements of section 24 and the protective devices are functioning properly

             (a)  periodic supervision may be authorized by the chief inspector for a guarded

                      (i)  heating plant having a kilowatt rating of 6,000 kilowatts or less,

                     (ii)  power plant having a kilowatt rating of 2,000 kilowatt or less;

                    (iii)  compressed gas plant having an unlimited kilowatt capacity,

                    (iv)  refrigeration plant having a kilowatt rating 200 or less or a kilowatt rating of 750 or less when a plant uses only Group A1 refrigerants; and

             (b)  combined pressure plant having an unlimited kilowatt rating so long as the limits imposed in paragraph (a) have not been exceeded.

             (2)  Minimum supervision may be authorized by the chief inspector for a guarded

             (a)  heating plant having a kilowatt rating of 4000 kilowatts or less; and

             (b)  compressed gas plant having a kilowatt rating of 800 kilowatts or less.

Fail safe devices

      24. (1) The owner of a boiler in a guarded power plant or a guarded heating plant shall provide the boiler with protective devices, satisfactory to the chief inspector, including

             (a)  2 separate high pressure limiting devices on the steam boiler or 2 separate high temperature limiting devices on the hot water boiler, one of which is mounted separately from the operating high limit;

             (b)  a low water level limiting device separate from another device that controls the feedwater supply to the boiler;

             (c)  a high water level limiting device separate from another device that controls the feedwater supply to the steam boiler;

             (d)  a purge and flame failure device that will automatically prevent the supply of fuel to the boiler when an abnormal condition occurs during the operation of the boiler;

             (e)  2 solenoid valves which are installed on the oil supply line to the burner; and

              (f)  other devices as may be required by an inspector.

             (2)  The owner of a guarded refrigeration plant shall provide protective devices, satisfactory to the chief inspector, including where applicable

             (a)  a high liquid level limiting device;

             (b)  a high temperature limiting device;

             (c)  a low pressure limiting device in the lubricating oil system;

             (d)  high discharge pressure shut down;

             (e)  excessive vibration shutdown; and

              (f)  other devices as may be required by an inspector.

             (3)  The owner of a guarded compressed gas plant shall provide protective devices, satisfactory to the chief inspector, including

             (a)  a high temperature limiting device in the compressor discharge line;

             (b)  a high temperature limiting device in the cooling water discharge line;

             (c)  a low pressure limiting device in the lubricating oil system;

             (d)  excessive vibration shut down;

             (e)  high discharge pressure shut down; and

              (f)  other devices as may be required by an inspector.

             (4)  The owner of a guarded plant referred to in section 23 shall provide the plant with an audible and visual alarm system that will ensure that the power engineer or operator is warned when an abnormal or unsafe condition occurs whether or not he or she is on the premises.

             (5)  Each protective device prescribed in subsections (1) to (4) shall

             (a)  be incapable of automatically restarting the plant; and

             (b)  maintain a visual warning until the abnormal or unsafe condition is rectified.

Where no protective devices

      25. Where a protective device in a guarded plant ceases to function properly, the owner shall ensure that the plant is not operated unless

             (a)  a power engineer or operator, as required by Part II, is in constant attendance in the plant; or

             (b)  the protective device has been repaired or replaced and tested and found to function properly, by a person competent to do so.

Isolation of boilers and compressors

      26. (1) The owner of a boiler or a prime mover of a compressor that is not included in determining the total kilowatt rating of a plant shall notify the chief inspector that the boiler or compressor is to be isolated.

             (2)  A boiler or prime mover of a compressor that is not included in determining the total kilowatt rating of a plant shall be isolated by an inspector sealing it in a manner that a boiler or compressor is incapable of being used without removal of the seal.

             (3)  Except with permission of the chief inspector, no person shall remove a seal that has been affixed to a boiler or compressor by an inspector.

Effect of increase in kilowatt rating

      27. (1) Where a power engineer or operator operated a registered plant continuously for 2 consecutive years immediately before the kilowatt rating of the plant is increased so that the power engineer or operator is no longer certified to operate the plant, the chief inspector may allow the power engineer or operator to continue to operate the plant for a period of

             (a)  9 months where there is a Power Engineer Fourth Class, or a Refrigeration Operator "B" Class;

             (b)  15 months where there is a Power Engineer Third Class; or

             (c)  18 months where there is a Power Engineer Second Class.

             (2)  In order to continue operating beyond the period laid down in subsection (1), a power engineer or operator is required to successfully complete the examination required in the circumstances by the chief inspector.

Coil tube boilers

      28. A power engineer is not required to be in attendance at a plant that is comprised solely of coil tube boilers and either

             (a)  each boiler contains steam at a pressure of more than 103 kilopascals or water at a temperature of more than 121° C and the total output does not exceed 3,600 kilowatts or the total water content does not exceed 1,125 litres; or

             (b)  each boiler contains steam at a pressure of 103 kilopascals or less or water at a temperature of 121° C or less and the total output does not exceed 12,000 kilowatts or the total water content does not exceed 3,375 litres.

PART IV
REGISTRATION OF DESIGNS AND LICENCES AND PERMITS

Except as otherwise required by these regulations, the manufacturer and supplier shall ensure the design requirements for all boilers, pressure vessels, fittings, fired heater pressure coils and pressure piping shall be in accordance with CSA B51, Boiler, Pressure Vessel and Pressure Piping Code.

Authentication of designs

      31. (1) Drawings and specifications of designs of boilers, pressure vessels, fittings, fired heater pressure coils and pressure piping shall be submitted by the manufacturer to the government service centre and shall include the signature and seal of a professional engineer.

             (2)  Drawings and specifications of boilers, pressure vessels and fittings designed and fabricated outside of the province shall include the signature and seal of a professional engineer who is a registered member of a recognized association of engineers and who is engaged in the practise of mechanical engineering.

Exempt from registration

      32. The following pressure plant piping designs are not required to be submitted for registration unless required by the chief inspector but shall otherwise comply with the regulations

             (a)  power plants that do not exceed 600 kilowatts;

             (b)  heating plants that do not exceed 1,800 kilowatts;

             (c)  refrigeration plants that do not exceed 75 kilowatts or 450 kilowatts in the case of group A1 refrigerants;

             (d)  compressed gas plants that do not exceed 250 kilowatts; and

             (e)  compressed air plants that are portable.

Quality control required in fabrication

      33. A person who fabricates a boiler, pressure vessel, pressure piping system or fitting in the province is responsible for providing and implementing a program of quality control satisfactory to the chief inspector to ensure that the fabrication complies with these regulations and the Act.

Licence required to repair or install pressure systems

      34. (1) A person who undertakes to fabricate, install, make alterations or repairs to a pressure system is required to hold a contractor's licence, but operating personnel may perform routine maintenance or minor repairs to their own plant, notwithstanding that they do not hold a contractor's licence.

             (2)  Where a question arises as to what constitutes routine maintenance or minor repairs, the chief inspector's decision is final.

             (3)  A person shall apply to the chief inspector for a contractor's licence on the form set by the chief inspector.

             (4)  The chief inspector may issue a contractor's licence where the applicant provides proof of the implementation of a program of quality control satisfactory to the chief inspector.

             (5)  The chief inspector may for cause, revoke or cancel any licence or suspend any licence.

             (6)  The following are causes for suspension, revocation or cancellation of a licence:

             (a)  a violation of a provision of the Act by the contractor or an agent or employee or by a person working directly under the contractor's supervision;

             (b)  the making of false statements with respect to any matter within the scope of the Act;

             (c)  incompetency;

             (d)  dereliction of duty;

             (e)  improper or fraudulent use of a licence; and

              (f)  poor performance of work and laxity in complying with regulations governing work or in rectifying faults or defects in work.

Permit required

      35. (1) Before a person commences to fabricate, install, alter or repair a pressure system the person is required to hold a contractor's licence issued under section 34 and in relation, to the fabrication, installation, alteration or repair, is required to hold a permit issued by the chief inspector.

             (2)  The chief inspector shall not issue a permit unless the person

             (a)  applies in writing for the permit;

             (b)  provides a description of the work to be done;

             (c)  provides the particulars of the machinery and components to be used;

             (d)  provides details on the ownership and purpose for which the premises are to be used;

             (e)  provides those other details as may be required by the chief inspector; and

              (f)  has registered all necessary drawings and specifications.

             (3)  The person applying for the permit shall provide to the chief inspector the name of the tradespeople who will do the work and the number on the certificate of competency issued to the tradespeople.

             (4)  The person to whom a permit is issued under this section shall display the permit in the main office at the site of the fabrication, installation, alteration or repair.

             (5)  A permit shall not be required for work performed by operating personnel holding certificates of competency for routine maintenance or minor repairs to their own plant.

             (6)  Where a person completes work under a permit, the person shall notify the chief inspector who

             (a)  may order an inspection of the system and authorize the use of the system upon completion of a satisfactory inspection; or

             (b)  may authorize the use of the system where the person who completed the work provides confirmation to the chief inspector's satisfaction, that the work meets the requirements of the applicable code in the opinion of a person considered qualified by the chief inspector.

INSPECTION AND TESTING

      36. Except as otherwise required by these regulations, the standards governing the inspection, testing and repair of boilers, pressure vessels, fired heater pressure coils, or piping shall be those in the CSA B51 Boiler, Pressure Vessel and Pressure Piping Code.

      37. Where in the opinion of the chief inspector circumstances require and justify a modification of the regulations, the chief inspector may make the changes that are necessary so long as they relate only to inspection, testing and repair provisions of boilers, pressure vessels, fired heater pressure coils or piping.

Audit inspection

      38. Where an owner of a registered plant has implemented a quality control program acceptable to the chief inspector that demonstrates the competency to perform repairs, replacement and modification of pressure systems and the ability to carry out detailed inspections and recording of pressure system conditions, the chief inspector may in relation to the registered plant implement an audit inspection system.

      39. All pipe welds larger than 50 millimetres nominal pipe size to carry steam at a pressure exceeding 3,500 kilopascals or a temperature exceeding 400° C shall, unless otherwise approved by the chief inspector, be examined by radiography by an examiner acceptable to the chief inspector in addition to standard testing practices.

      40. Where a boiler, pressure vessel or pressure piping system is being tested or is first being put into service, the owner or person in charge of the testing procedure shall ensure that persons required to be in attendance for the test or initial start-up are present.

      41. Before any pressure piping system is tested, the person to whom the permit for installation was issued shall inspect the system to make sure that the materials, construction, identification and installation comply with the regulations.

Test of pressure piping system

      43. (1) Where a pressure piping system which includes pressure vessels, is going to be tested, the person in charge of the testing procedure shall ensure the test liquid temperature is not less than 16° C with the pressure not being applied until all the pressure parts and the test liquid are approximately at the same temperature.

             (2)  Pressure piping unless otherwise approved by the chief inspector shall be pressure tested in accordance with the applicable code.

Identification stamping

      44. (1) The fabricator of boilers, pressure vessels or heat exchangers fabricated in Canada for use in the province shall ensure conformation in every detail of the CSA B51 provision on stamping.

             (2)  A person who stamps boilers, pressure vessels or heat exchangers fabricated outside Canada for use in the province shall ensure the stamps

             (a)  comply with the ASME Code;

             (b)  include the CRN ; and

             (c)  include the NBBI number.

             (3)  The location of the stamping shall be in accordance with ASME Code requirements unless otherwise approved by the chief inspector.

             (4)  Identification stamping referred to in this section shall be kept free of any covering so that the stamping is freely accessible to an inspector and where this is impracticable, the identification shall also be stamped upon a permanently attached plate which shall be kept free of covering and be in addition to the stamping on the vessel.

             (5)  Where an inspector completes an initial inspection he or she shall stamp an identifying number upon the pressure vessel, boiler or heat exchanger adjacent to the stamping required by subsections (1) and (2).

             (6)  Where a boiler or pressure vessel has not been stamped by the manufacturer with the required CRN the owner shall pay the fee as may be set by the minister.

Owner's role in inspections

      45. The owner or operator of a boiler or pressure vessel shall

             (a)  furnish the labour and material necessary for an inspection; and

             (b)  take other action required by an inspector for the performance of his or her duties.

Certificate of inspection

      46. A certificate of inspection, as designed by the chief inspector shall be issued by an inspector authorizing the operation or use of a boiler or pressure vessel from the date of the certificate until the expiry date unless withdrawn, cancelled or suspended by the chief inspector.

Cancellation of certificate

      47. An inspector may cancel a certificate of inspection pertaining to a boiler or pressure vessel if the owner fails to comply with instructions given by an inspector in respect of the Act and these regulations within the time specified by an inspector or, where no time has been specified, within reasonable time.

Notification of installation

      48. (1) An owner shall notify the chief inspector prior to the import of nonregistered or used boilers or pressure vessels, and prior to the installation of used boilers or pressure vessels the owner may be required to provide the following to the chief inspector:

             (a)  design drawings and specifications;

             (b)  manufacturers data report;

             (c)  the last inspection report from an acceptable inspection agency; and

             (d)  the name plate data.

             (2)  A person shall not place into service used boilers or pressure vessels until accepted by an inspector and the following tests are satisfactorily completed:

             (a)  visual inspection;

             (b)  nondestructive testing as may be required to confirm the thickness of material, the condition of the welds and the soundness of the base metal; and

             (c)  pressure testing of 1.5 times the maximum allowable working pressure as determined by an inspector.

             (3)  An inspector may refuse to inspect a used pressure vessel that is painted or covered over with a metal or coating that inhibits the inspector's ability to examine it and determine its condition.

Validity of inspection

      49. A person shall not classify a boiler, pressure vessel or plant as being in a safe or good condition if it has been otherwise classified by an inspector without first obtaining permission in writing from the chief inspector.

Safety valves

      50. (1) Subject to subsection (2) every boiler, pressure vessel or pressure system shall have at least one safety valve of adequate capacity set to relieve at or below its maximum allowable pressure.

             (2)  Where more than one boiler or pressure vessel is connected in a plant for use at a common operating pressure, they shall be protected by one or more safety valves of adequate capacity set to relieve at or below the maximum allowable pressure of the weakest boiler or pressure vessel in the plant.

             (3)  While a boiler, pressure vessel or plant is in operation or use, a person shall not alter, interfere with or render inoperative any safety device that is attached to the boiler, pressure vessel or plant.

Repair and setting of safety valves

      51. (1) A person who alters, makes repairs to, resets or reseals safety or relief valves shall be licensed to do so in accordance with the regulations.

             (2)  An owner may, on approval of the chief inspector and under the direction of an inspector, reset and seal safety or relief valves in accordance with the manufacturer's specifications and within the code tolerances.

Non-destructive examination - NDE

      52. (1) A person who performs nondestructive examination on a boiler, pressure vessel or piping system is required to be licensed to do so in accordance with the regulations.

             (2)  An inspector may request from an owner or person in charge of a boiler, pressure vessel or pressure piping system, a radiographic, ultrasonic, magnetic particle, or another method of nondestructive examination to be performed during the construction or service life of the boiler, pressure vessel or pressure piping system.

             (3)  Where a nondestructive examination referred to in subsection (2) has been completed or another type of inspection of a boiler or pressure vessel has been performed by the owner or his or her representative a report of the nondestructive examination or inspection shall be provided to the government service centre.

WELDING OF PRESSURE SYSTEMS

      54. A person shall not weld during rain, snow, sleet or high wind unless the work and the welder are protected from the rain, snow, sleet or wind.

Responsibility for welding

      56. (1) Every manufacturer, contractor, welding shop operator or other person who welds or employs a person to do welding upon a pressure system is responsible for the quality of that welding and before that welding is done he or she shall

             (a)  conduct or cause to be conducted, welding procedure qualification tests in accordance with the ASME Code section IX to ensure that the procedure to be used will produce sound and ductile welds meeting the requirements of the code and submit to the chief inspector for registration proof of those tests in the form prescribed by the chief inspector; and

             (b)  arrange with the chief inspector for performance qualification tests or obtain approval on an equivalent performance qualification test which has met the requirements of the ASME Code section IX and has been witnessed by the inspector or other person authorized by the chief inspector.

Pressure welder's test

      57. (1) An applicant for a pressure welder's performance qualification test shall

             (a)  show proof that he or she has acquired a journeyman's welder certificate; or

             (b)  show proof that he or she has been previously certified by a jurisdiction acceptable to the chief inspector.

             (2)  The test for a pressure welder's performance qualification for ferrous and nonferrous material shall meet the requirements of ASME Code section IX.

Welder's continuity

      58. (1) The performance qualification of a pressure welder shall remain valid until one of the following conditions occur:

             (a)  when the pressure welder has not welded using a specific process during a period of six months or more, their qualifications for that process shall expire; or

             (b)  when there is specific reason to question a welder's ability to make welds that meet the specification, the qualification which supports the welding process that is being questioned shall be revoked and all other qualifications not questioned remain in effect.

             (2)  Proof of continuing qualification shall be documented and maintained in the form as prescribed by the chief inspector.

             (3)  The chief inspector may require welding tests to be performed periodically for the purpose of verifying continued qualification.

Stamping of work

      59. (1) Every pressure welder under these regulations shall be assigned a symbol by the chief inspector and the pressure welder shall stamp all work performed by him or her with the assigned symbol as required by the ASME Code or as prescribed by the chief inspector so that the symbol will be readily visible to an inspector and in the following manner:

             (a)  on new work including pressure piping, at one metre intervals along all seams and joints and on each separate weld; and

             (b)  on repair work at 300 millimetre intervals along all seams and joints and on each separate weld.

             (2)  The welder performance qualification record of a pressure welder shall be cancelled if he or she

             (a)  fails to stamp his or her work with the symbol assigned as specified in subsection (1);

             (b)  stamps work not performed by him or her;

             (c)  allows another person to use his or her assigned symbol;

             (d)  consistently does unacceptable welding;

             (e)  falsifies a record pertaining to their performance qualification; or

              (f)  fails a welding test administered by an inspector.

Repair requirement

      60. (1) A pressure welder may make repairs only to steels having known weldable quality and to carbon steels having a carbon content of not more than 0.35% and low alloy steels having a carbon content of not more than 0.25%.

             (2)  A pressure welder may make repairs only if they meet the requirement of the CSA B51 Code and the National Board Inspection Board.

             (c)  CAN/CSA -B149.3 Code for the Field Approval of Fuel-Related Components on Appliances and Equipment.

      62.       64. (1) Where a person intends to install gas piping systems, appliances or fittings exceeding 211,000 kilojoules or those requiring the submission of design drawings as required by section 76, the person is required to apply for an installation permit prior to the installation.

             (2)  The chief inspector shall not issue installation permits unless the applicant holds an applicable certificate referred to in section 71.

Plant licence requirement

      65. A person, firm or corporation storing or distributing gas, installing or servicing gas systems, installing or servicing gas equipment or operating a gas dispensing unit for filling portable cylinders shall apply to the chief inspector for an annual licence for each place of business and the chief inspector shall issue a licence to approved applicants.

Plant licences

      66. Plant licences shall be issued as follows:

             (a)  Class "A" authorizing the holder to establish a filling plant or distribution plant where portable cylinders, vehicle fuel tanks, transport tanks or other approved containers may be filled and to make gas installations, repair and service gas appliances and participate in any operation authorized by Class "B" or Class "C" licence;

             (b)  Class "B" authorizing the holder to establish a plant for distribution of gas by means of cylinders; and

             (c)  Class "C" authorizing the holder to establish a gas dispensing unit for the purpose of filling portable cylinders and motor vehicle fuel tanks.

Chief inspector to issue

      67. (1) Licences provided for in section 66 shall be issued by order of the chief inspector and where it is not certain which class of licence is required, the chief inspector shall decide the class necessary to comply with these regulations.

             (2)  The chief inspector may withhold, cancel or suspend a licence for a violation of a part of the Act or regulations.

             (3)  A licence shall be produced on demand of an inspector and the nonproduction of the licence is, in the absence of evidence to the contrary, proof that the person concerned has no licence.

      68. A person shall not distribute gas in containers greater than 2.5 kilograms capacity or install gas equipment without first having obtained a licence as required under these regulations.

      69. A licensed plant shall establish and maintain an approved training program for the purpose of training employees prior to examination of those personnel for certification under section 71.

      70. A licensed plant shall ensure that personnel carrying out the functions permitted by the licence hold the necessary certification.

Certification of personnel

      71. (1) A person who

             (a)  installs, repairs, services or verifies gas burning appliance or equipment;

             (b)  operates a truck transporting gas;

             (c)  operates a gas filling plant; or

             (d)  installs, repairs or services a gas system

shall not do so unless he or she holds a certificate authorizing him or her to perform those duties.

             (2)  Certificates renewable on or before January 1 of each year may be issued in the following categories for the following activities:

             (a)  Gas Fitter, for the installation, alteration, purging, activation, service, repair or removal of installations to a maximum heating value of 633,000 kilojoules per hour;

             (b)  Gas Installer, for the installation, alteration, purging, activation, service, repair or removal of gas appliances, equipment, systems, cylinders and tanks as well as all operations authorized in paragraph (a);

             (c)  Gas Verifier, permits the verifications of installations completed by other personnel certified in accordance with paragraphs (a) and (b);

             (d)  Bulk Plant Operator, permitting the holder to load and unload tank cars, cargoliners and tank trucks into or from a filling plant, fill containers and maintain a filling plant;

             (e)  Tank Truck Operator, permitting the holder to operate a tank truck transporting gas;

              (f)  Cargo Liner Operator, permitting the holder to operate a cargo liner transporting gas; and

             (g)  Container Refill Centre Operator, permitting the holder to operate a container refill centre or service station to fill portable cylinders and to fill propane fuel tanks permanently attached to a motor vehicle.

             (3)  The chief inspector may suspend or cancel a certificate issued under this Part for any reason set out in section 8.

Qualification of candidates

      72. (1) A candidate for a certificate referred to in section 71 shall

             (a)  complete and file with the government service centre the prescribed form; and

             (b)  successfully complete an examination set by the chief inspector.

             (2)  A candidate for examination shall provide proof of completion of an approved training program.

             (3)  A candidate prior to writing the examination referred to in paragraph (1)(b) is required,

             (a)  in relation to a Gas Fitter's Certificate, to have at least 6 months' experience assisting in the installation of gas piping systems under the supervision of a certificate holder;

             (b)  in relation to a Gas Installer's Certificate, to be the holder of a Gas Fitter's Certificate for at least one year;

             (c)  in relation to a Gas Verifier's Certificate, to be the holder of a Gas Installer's Certificate for at least 6 months;

             (d)  in relation to a Bulk Plant Operator's Certificate, to have at least 6 months' experience in the operation of a bulk plant under the supervision of a certified Bulk Plant Operator;

             (e)  in relation to a Tank Truck Operator's Certificate, to

                      (i)  have at least 30 days' experience assisting in the operation of a tank truck under the direct supervision of a person holding a valid Tank Truck Operator's Certificate, and

                     (ii)  have the appropriate class of driver's licence;

              (f)  in relation to a Cargo Liner Operator's Certificate, to

                      (i)  have at least 6 months' experience in the handling of tractor trailers, one month of which shall be on a gas cargo liner under the direct supervision of a person holding a valid Cargo Liner Operator's Certificate, and

                     (ii)  have the appropriate class of driver's licence; and

             (g)  in relation to a Container Refill Centre Operator's Certificate, to have successfully completed the course prescribed by the chief inspector.

Renewal and audits

      73. (1) A certificate referred to in section 71 may be renewed by the chief inspector without written examination when the holder

             (a)  makes application in the form provided by the government service centre;

             (b)  has been employed in that certificate level during the previous year; and

             (c)  pays the fee as may be set by the minister.

             (2)  An inspector may occasionally or as directed by the chief inspector audit the performance of Gas Verifier Certificate holders.

      74. Filling plants including container refill centres shall be equipped with an automatic shut-off device to stop the flow of gas into cylinders.

Cylinders to be fit

      75. A gas supplier holding a Class A or C licence shall not fill cylinders unless he or she is satisfied that the cylinder is in good physical condition and that the cylinder will be transported in a safe and acceptable manner.

Design registration

      76. (1) Plans and specifications of the design, in duplicate, shall be submitted to the chief inspector for registration for

             (a)  gas installations in buildings designated as public assembly;

             (b)  filling plants;

             (c)  container refill centres; and

             (d)  gas installations having a total heating value of 633,000 kilojoules and over.

             (2)  Drawings and specifications shall include

             (a)  piping layout for each floor, including vertical runs servicing all floors;

             (b)  calculation of pipe size to prove adequate supply of gas to all appliances if requested;

             (c)  details showing location of gas piping supports, detail of piping supports and protection of piping and tank;

             (d)  number and location of cylinders or tanks;

             (e)  schedule of fittings and valves showing registration as required by Part IV of these regulations;

              (f)  the manufacturer, listing agency, the file number and thermal rating of appliances included in the system;

             (g)  a statement that the installation is to be made by personnel holding the proper certificate as required by these regulations; and

             (h)  the signature and seal of a professional engineer.

Inspection and inspectors

      77. A person shall not use a pressure vessel for the storage or distribution of gas unless the pressure vessel has been fabricated and stamped in accordance with the requirements of the ASME Code, section VIII, except that a cylinder up to and including 454 kilograms water capacity may be fabricated and stamped in accordance with the requirements of the Canadian Transport Commission or the United States Department of Transport.

      81. A person shall not fill with gas a pressure vessel that shows corrosion, dents, bulges or other damage but the person shall report it to the chief inspector.

PART VIII
MEDICAL GAS SYSTEMS

Application

      82. This Part applies to the construction, testing, operation and maintenance of nonflammable medical gas piping systems where these systems are used for the purpose of heath care in any facility and this Part applies to piping systems for the following medical gases:

             (a)  oxygen;

             (b)  nitrous oxide;

             (c)  medical air;

             (d)  medical vacuum or suction;

             (e)  nitrogen;

              (f)  carbon dioxide;

             (g)  helium; and

             (h)  any mixture of the gases referred to in paragraphs (a) to (g).

             (a)  CSA Z7396.1 Medical Gas Pipeline Systems; and

Medical gas contractor

      84. A person shall not work on new installations, extensions, alterations, routine maintenance or repairs to medical gas systems unless he or she is licensed as a medical gas contractor under these regulations and has obtained the appropriate permit in accordance with these regulations.

      85. A person who installs, repairs or services a medical gas system is required to hold a medical gas installer certificate.

Qualification of candidates

      86. (1) A person may not be a candidate for a medical gas installer certificate unless that person completes and files with the government service centre the appropriate application form.

             (2)  A candidate for a medical gas installer's certificate is required to

             (a)  hold a certificate of trades qualification in the plumbing or pipefitting trade or have equivalent experience in servicing medical gas systems;

             (b)  pass a written examination based on the CSA Standard Z7396.1 Medical Gas Pipeline Systems; and

             (c)  pass a test for a brazer's performance qualification in accordance with the procedure determined by the chief inspector.

Design registration

      87. (1) Prior to starting the installation of a new medical gas system or the extension or alteration to an existing installation, the person doing the installation, extension or alteration shall submit the design in duplicate to the chief inspector, and shall include the signature and seal of the professional engineer responsible for the design.

             (2)  After installation and prior to commissioning of a medical gas piping system, the medical gas contractor responsible for the work shall submit a set of "as built" drawings to the chief inspector for filing and future reference.

Inspection

      88. After the installation of a medical gas system is completed, or a phase of the installation is completed, the inspector shall satisfy himself or herself that all the provision of these regulations and adopted standards have been carried out.

Pressure test required

      89. (1) After the inspection required by section 88 is complete, the system shall be subjected to a pressure test for which the inspector shall supervise the installation of the pressure recorder and each chart shall be dated, installed, and removed by the inspector.

             (2)  After completion of pressure tests a nitrogen charge of 345 kilopascals shall be held in each system to ensure no damage is sustained to the pipe lines and in the event there is a loss of pressure the system shall be repaired and tested.

Medical gas testing agency

      90. (1) The concentration, purity and flow test requirements required by the adopted standard may be carried out by a medical gas testing agency licensed to operate within the province.

             (2)  The testing agency shall submit to the chief inspector, a signed copy of the tests carried out on a medical gas system, before it is put into operation.

             (3)  It shall be the responsibility of the contractor or medical gas facility to employ the testing agency and to ensure that the reports required in subsection (2) are submitted to the chief inspector.

             (4)  Before carrying out testing in the province the medical gas testing agency shall present credentials and make application to the chief inspector for a licence to operate within the province.

             (a)  CSA B52 - Mechanical Refrigeration Code; and

Transportation

      92. Where a vehicle owned by the province is used for transportation of an inspector and under these regulations, a charge can be made for the cost of transportation, the cost shall be computed at the rate allowed for inspectors using their own cars.

Delayed inspection

      93. Where an inspector is unable in one visit to commence or complete an inspection of a pressure system or qualification test of a welder, because of failure of the owner or contractor of the pressure system or the employer of the welder to comply with the inspector's requirements, the owner, contractor or employer shall in addition to the fee set by the minister, pay the cost of transportation and subsistence charges incurred in returning for or continuing the inspection or test and the per hour charges as set by the minister.

      94. No fee shall be charged or imposed in respect of an inspection of a pressure system in any institution which in the opinion of the minister is a charitable institution or an institution of a charitable nature.
