Hebron Development Project Special Project Order
under the
Labour Relations Act

Under the authority of section 70 of the Labour Relations Act, the Lieutenant-Governor in Council makes the following Order.

ORDER

Analysis



Short title

        1. This Order may be cited as the Hebron Development Project Special Project Order .

Special project declared

        2. It is declared that the undertaking with respect to the construction or fabrication activities of the Gravity Base Structure, Topsides and Platform Hook-Up for the Hebron Development Project that will occur in Great Mosquito Cove, Bull Arm area of Trinity Bay, Newfoundland and Labrador, including the onshore, atshore and inshore locations, and construction or fabrication activities of the Gravity Base Structure, Topsides and Platform Hook-Up for the Hebron Development Project that will commence in that area and require completion offshore by the same Hebron Project Employers' Association Inc. contractor or subcontractor, and solid ballasting of the Gravity Base Structure, Topsides and Platform Hook-Up for the Hebron Development Project that will occur in that area or offshore, is a special project.

Exclusion

        3. With the exception of construction activity associated with supplying power to the Hebron Development Project that will occur in Great Mosquito Cove, Bull Arm area of Trinity Bay, the designation of the special project under this Order does not include the repair, maintenance, construction, installation or inspection, or activities related to the repair, maintenance, construction, installation or inspection, of electric power lines, towers, and associated infrastructure and rights of way in Great Mosquito Cove, Bull Arm area of Trinity Bay, Newfoundland and Labrador.

Parties who may bargain collectively

        4. The parties that may be involved in collective bargaining in relation to employment on the special project are the Hebron Project Employers' Association Inc., as the employers' organization acting for and on behalf of all contractors and all subcontractors carrying out work on the special project, and the Resource Development Trades Council of Newfoundland and Labrador, as the council of trade unions acting for and on behalf of all affiliated unions which represent employees employed on the special project.

Collective agreement

        5. The collective agreement entered into between the Hebron Project Employers' Association Inc. and the Resource Development Trades Council of Newfoundland and Labrador dated August 31, 2011 ("the agreement") is the collective agreement for the purpose of the special project.

Single bargaining unit

        6. For the purposes of the special project, all employees employed on the special project under the agreement are considered to be members of a single bargaining unit.

Gender equity and diversity program

        7. This Order acknowledges the commitment contained in Article 5.11 of the Hebron Benefits Agreement dated August 20, 2008 with respect to the development of a Gender Equity and Diversity Program.

Duration of Order

        8. This Order remains in effect for the duration of the work, including mobilization and de-mobilization by the contractors, as provided for in the agreement.
