Under the authority of section 21 of the Prescription Monitoring Act , the Lieutenant-Governor in Council makes the following regulations.

Short title

        1. These regulations may be cited as the Monitored Drugs Regulations .

Definitions

        2. In these regulations

             (a)  "dispense" means to provide a substance or item ordered by prescription but does not include the administration of that substance or item to a person or animal;

             (b)  "dispensing dentist" means a dentist licensed under the Dental Act, 2008 who dispenses monitored drugs in the course of his or her practice;

             (c)  "dispensing physician" means a medical practitioner licensed under the Medical Act, 2011 who dispenses monitored drugs in the course of his or her practice;

             (d)  "dispensing registered nurse" means a registered nurse licensed under the Registered Nurses Act, 2008 who dispenses monitored drugs in the course of his or her employment with the Provincial Health Authority ;

             (e)  "hospital" means an acute care health facility operated by the Crown or an agent of the Crown for the care of diseased, injured or sick people but does not include a residential long term care facility;

             (f)  "Provincial Health Authority" means the Provincial Health Authority established under the Provincial Health Authority Act ; and

             (g)  "veterinarian" means a veterinarian licensed under the Veterinary Medical Act, 2004 who prescribes and dispenses monitored drugs in the course of his or her practice.

Monitored drugs

        3. For the purposes of paragraph 2(1)(e) of the Act the following are monitored drugs:

             (a)  opioids listed in Schedule 1 of the Controlled Drugs and Substances Act (Canada ); and

             (b)  tramadol.

Non-application of Act

        4. (1) The Act does not apply to

             (a)  the dispensing of a monitored drug by a dispenser who dispenses a monitored drug to a patient in a hospital to be administered in the hospital; and

             (b)  the prescribing and dispensing of a monitored drug by a veterinarian.

             (2)  Subsection 8(3) of the Act does not apply to a dispensing   dentist, dispensing physician or a dispensing registered nurse.
