CONSOLIDATED NEWFOUNDLAND AND LABRADOR REGULATION 1037/96

Butter Pot Provincial Park Proclamation
under the
Provincial Parks Act
(O.C. 96-189)

Under the authority of section 4 of the Provincial Parks Act and the Subordinate Legislation Revision and Consolidation Act , the Lieutenant-Governor in Council proclaims the area described in the Schedule to be a provincial park.

The Butter Pot Park Proclamation, Newfoundland Regulation 106/91, is repealed.

Schedule

All that piece or parcel of land situate and being at Butter Pot in the province, abutted and bounded as follows, that is to say:

Beginning at a point in the northwestern limit of the Trans Canada Highway, 90 metres wide, that point being distant 1,745.99 metres as measured on a bearing of north 23° 42' 51" east from Control Monument No. 926033;

Then running along the northwesterly limit of the Trans Canada Highway along the arc of a curve to the left having a radius of 636 metres to a point being distant 112.78 metres as measured on a bearing of south 33° 24' 41" west from the last mentioned point;

Then running along the northwesterly limit of the Trans Canada Highway south 28° 19' 28" west 2,824.29 metres;

Then south 33° 28' 02" west 502.02 metres;

Then south 23° 10' 54" west 502.02 metres;

Then south 28° 19' 28" west 285.04 metres;

Then running along the arc of a curve to the left having a radius of 1,804 metres to a point being distant 638.98 metres as measured on a bearing of south 18° 07' 25" west from the last mentioned point;

Then running along the northwesterly limit of the Trans Canada Highway south 7° 55' 22" west 1,564.35 metres;

Then running along the northwesterly limit of the Trans Canada Highway along the arc of the curve to the right having a radius of 846 metres to a point being distant 621.59 metres as measured on a bearing of south 29° 28' 35" west from the last mentioned point;

Then running along the northwesterly limit of the Trans Canada Highway south 51° 01' 47" west 727.42 metres;

Then running by Crown land north 48° 45' 28" west 2,536.02 metres;

Then north 9° 46' 27" east 851.46 metres;

Then north 32° 00' 15" east 919.84 metres;

Then north 35° 35' 10" west 2,307.31 metres, more or less;

Then running along the centre line of the Newfoundland Light and Power Company Limited transmission line easement, 52 metres wide, north 1° 17' 57" west 267.50 metres;

Then running by Crown land north 33° 08' 23" east 3,184.45 metres;

Then running by Crown land, by land granted by the Crown to Jabez Butler and registered in Volume 131, Folio 131 in the Registry of Crown Grants and by land applied for by Alex Butler south 89° 53' 14" east 1,417.44 metres;

Then running by that land applied for by Alex Butler north 42° 33' 15" east 610.19 metres;

Then running by land occupied by Gerald Skanes south 18° 02' 00" east 197.31 metres;

Then south 18° 43' 47" west 103.36 metres;

Then south 88° 55' 48" east 131.26 metres;

Then north 37° 57' 39" east 320.12 metres, more or less;

Then running by land described in Lease No. 56121 issued by the Crown to Newfoundland and Labrador Hydro south 79° 12' 15" east 584.41 metres;

Then running by Crown land south 42° 39' 43" east 2,095.65 metres, more or less, to the point of beginning.

Reserving nevertheless out of the above described piece or parcel of land all that piece or parcel of land being a Newfoundland Light and Power Company dam site on Finnies Pond, abutted and bounded as follows, that is to say:

Beginning at a point, that point being a distance of 2,969.44 metres on a bearing of north 16° 10' 08" west from Control Monument No. 926042 (Monument No. 926042 having co?ordinates north 5,245,533.23 and east 300,348.60 metres and the bearing from Monument No. 926042 to Control Monument No. 926043 being north 49° 03' 30" east);

Then by Butter Pot Provincial Park south 89° 35' 29" east for a distance of 360.14 metres;

Then south 0° 26' 46" west for a distance of 119.95 metres;

Then north 89° 33' 44" west for a distance of 360.08 metres;

Then north 0° 25' 10" east for a distance of 119.07 metres, more or less, to the point of beginning and containing an area of 4.32 hectares.

All bearings being referenced to the above mentioned projection; all distances are horizontal ground distances.

The above described piece or parcel of land also being subject to a portion of a Newfoundland Light and Power Company transmission line easement, 52 metres wide, extending along a portion of the westerly boundary.

And also, being subject to all rights and privileges granted unto Conception Bay Electric Company, its heirs and successors (Newfoundland Light and Power Company Limited) under the Conception Bay Electric Company Act: 3 Geo V 1913 Cap 4 as amended.

The above described piece or parcel of land containing an area of 2,833.102 hectares, more or less, and being more particularly shown on Plan No. SP 224 in the Crown Lands Registry.

All bearings being referred to the meridian of 53° west longitude of the 3° Transverse Mercator Projection.
