Under the authority of the Newfoundland and Labrador Chicken Marketing Scheme , the Natural Products Marketing Act and the Subordinate Legislation Revision and Consolidation Act , the Lieutenant Governor in Council makes the following Order.

Analysis



Short title

        1. This Order may be cited as the Consolidated Chicken Farmers of Newfoundland and Labrador Order .

Meaning continued

        2. Unless the context otherwise requires, the words in this Order shall have the same meaning as set out in the Natural Products Marketing Act and theNewfoundland and Labrador Chicken Marketing Scheme .

Definitions

        3. In this Order

             (a)  "chicken" means a live chicken 6 months of age or less produced from the egg of the domestic hen which has not been raised for egg production; and

             (b)  "processor" means a person who slaughters, dresses or changes the nature of chicken by mechanical or other means and in appropriate cases shall include the commodity board.

Service charge

        4. A service charge of $0.0165 per kilogram, plus HST, payable live weight, will be made by the Chicken Farmers of Newfoundland and Labrador on all chicken marketed under the Newfoundland and Labrador Chicken Marketing Scheme and the charges shall be collected and paid to the Chicken Farmers of Newfoundland and Labrador by the processor on behalf of the producers within 30 days from the date of the processing of the chicken.

Minimum price

        5. The minimum price at which broiler chicken may be bought, sold or offered for sale F.O.B. producers premises in the province shall be 127.30 cents per kilogram live weight.

Exemption

        6. Chicken more than 6 months of age are exempt from this Order.

Underpricing prohibited

        7. A person shall not sell or offer for sale to a processor chicken at less than the minimum price determined by this Order.

Repeal

        8. The Newfoundland Chicken Marketing Board Order No. 33, Newfoundland Regulation 39/85, and the Newfoundland Chicken Marketing Board Order No. 37, Newfoundland Regulation 56/95, are repealed.
