EXPLANATORY NOTES Clause 1 of the Bill would repeal and replace section 19 of the City of St. John's Act to remove the ability of the mayor to vote a second time where there is an equality of votes. An equality of votes on a motion would then be considered to be a defeat of the motion. Clauses 2 to 5 of the Bill would amend sections of the Act that permit the borrowing of money by the city with the approval of the Lieutenant-Governor in Council. The amendments would require the approval of the Minister of Municipal and Provincial Affairs for that borrowing.
A BILL AN ACT TO AMEND THE CITY OF ST. JOHN'S ACT Analysis 1. S.19 R&S 2. S.90 Amdt. 3. Ss.301 and 302 Amdt. 4. S.309 Amdt. 5. S.310 Amdt. Be it enacted by the Lieutenant-Governor and House of Assembly in Legislative Session convened, as follows: RSNL1990 cC-17 1. Section 19 of the City of St. John's Act is repealed and the following substituted: Equality of votes 19. Where there is an equality of votes on a motion or resolution that motion or resolution shall be considered to be defeated.
2. Paragraph 90(2)(b) of the Act is amended by deleting the words "Lieutenant-Governor in Council" and substituting the words "Minister of Municipal and Provincial Affairs".
3. Sections 301 and 302 of the Act are amended by deleting the words "Lieutenant-Governor in Council" wherever they occur and substituting the words "Minister of Municipal and Provincial Affairs".
4. Section 309 of the Act is amended by deleting the words "Lieutenant-Governor in council" and substituting the words "Minister of Municipal and Provincial Affairs".
5. Section 310 of the Act is amended by deleting the words "Lieutenant-Governor in Council" and substituting the words "Minister of Municipal and Provincial Affairs". ©Earl G. Tucker, Queen's Printer |
