EXPLANATORY NOTE

This Bill would amend the Tobacco Health Care Costs Recovery Act to include the words "in the province" in the definition of "tobacco related wrong".

Be it enacted by the Lieutenant-Governor and House of Assembly in Legislative Session convened, as follows:

        1. Paragraph 2(m) of the Tobacco Health Care Costs Recovery Act is repealed and the following substituted:

            (m)  "tobacco related wrong" means a breach of a common law, equitable or statutory duty or obligation owed by a manufacturer to persons in the province who have been exposed or might become exposed to a tobacco product;
