EXPLANATORY NOTES

This Bill would amend the Workplace Health, Safety and Compensation Act to expand the immunity from legal action provided by the Act to include officers and employees of the commission, in addition to directors, and all actions performed or omitted to be performed in good faith.

The Bill would also amend the Act to extend the same protection from liability to officers, employees, advisors and commissioners of the review division.

Be it enacted by the Lieutenant-Governor and House of Assembly in Legislative Session convened, as follows:

        1. Section 14 of the Workplace Health, Safety and Compensation Act is repealed and the following substituted:

      14. An action or other proceeding does not lie against the commission or a director, officer or employee of the commission for anything done or omitted to be done in good faith in the course of exercising a power or carrying out a duty under this Act.

 

        2. The Act is amended by adding immediately after section 24 the following:

   24.1 An action or other proceeding does not lie against the chief review commissioner, the other review commissioners and the officers, employees and advisors of the review division for anything done or omitted to be done in good faith in the course of exercising a power or carrying out a duty under this Act.
