AN ACT FOR GRANTING TO HER MAJESTY CERTAIN SUMS OF MONEY FOR DEFRAYING CERTAIN EXPENSES OF THE PUBLIC SERVICE FOR THE FINANCIAL YEAR ENDING MARCH 31, 2012 AND FOR OTHER PURPOSES RELATING TO THE PUBLIC SERVICE

                   WHEREAS it appears that the sums mentioned are required to defray certain expenses of the Public Service of Newfoundland and Labrador for the financial year ending March 31, 2012 and for other purposes relating to the public service:

MAY IT THEREFORE PLEASE YOUR MAJESTY THAT-

Be it enacted by the Lieutenant-Governor and House of Assembly in Legislative Session convened, as follows:

Short title

        1. This Act may be cited as the Supply Act, 2011.

Further supply 2011-2012

        2. From and out of the Consolidated Revenue Fund there may be issued by the Minister of Finance and President of Treasury Board sums not exceeding $4,690,903,500 in addition to the sum of $2,669,600,600 authorized by the Interim Supply Act, 2011 the aggregate of the sums authorized to be issued under this Act and the Interim Supply Act, 2011 being $7,360,504,100.

Effect of authorization

        3. The sums authorized to be issued by this Act as set out in the Schedule shall be paid and applied by the several heads of expenditure in respect of the financial year extending from April 1, 2011 to March 31, 2012 towards defraying the charges and expenses of the Public Service of Newfoundland and Labrador as set out in the Schedule.

Transfer of Funds

        4. (1) Notwithstanding the Financial Administration Act, the Treasury Board may transfer sums, both current and capital, voted within one Head of Expenditure receiving the noted services to another Head of Expenditure providing the noted services, during the fiscal year ending March 31, 2012, for the provision of human resources, financial and related administrative services provided in the listed activities by a division serving multiple departments

             (a)  Executive Council activities, 2.5.01 Financial Administration and 2.5.02 Strategic Human Resource Management;

             (b)  Department of Finance activity 2.4.02 Corporate Services;

             (c)  Department of Government Services activity 1.2.02 Strategic Human Resource Management;

             (d)  Department of Innovation, Trade and Rural Development activity 1.2.05 Strategic Human Resource Management;

             (e)  Department of Natural Resources activity 1.2.02 Administrative Support; and

              (f)  Department of Municipal Affairs activity, 1.2.03 Strategic Financial Management.

             (2)  Notwithstanding the Financial Administration Act, the Treasury Board may transfer sums voted within the Department of Finance - Government Personnel Costs (1.3.01) to another Head of Expenditure during the fiscal year ending March 31, 2012, to facilitate expenditures for compensation, benefits and other associated adjustments.

             (3)  Notwithstanding the Financial Administration Act, the Treasury Board may transfer sums voted within Consolidated Fund Services - Ex Gratia and Other Payments (2.1.02) to another Head of Expenditure during the fiscal year ending March 31, 2012, to facilitate expenditures for special retirement and other payments.

             (4)  Notwithstanding the Financial Administration Act, the Treasury Board may transfer sums voted within the Department of Environment and Conservation - Policy Development and Planning (1.2.03) to another Head of Expenditure during the fiscal year ending March 31, 2012 to facilitate expenditures for Clean Air and Climate Change (Eco Trust) initiatives.

             (5)  Notwithstanding the Financial Administration Act, the Treasury Board may transfer sums voted within the Department of Finance - Financial Assistance (2.1.04 and 2.1.05) to another Head of Expenditure during the fiscal year ending March 31, 2012, to facilitate expenditures for financial assistance and initiatives consistent with the objectives of the Community Development Trust.

             (6)  Notwithstanding the Financial Administration Act, the Treasury Board may transfer sums voted within the Department of Health and Community Services to the Department of Child, Youth and Family Services during the fiscal year ending March 31, 2012, for the provision of human resource, financial, administrative and regional services affected by the implementation of the new Department of Child, Youth and Family Services.

             (7)  Notwithstanding the Financial Administration Act, the Treasury Board may transfer sums voted within the Department of Child, Youth and Family Services to the Department of Health and Community Services during the fiscal year ending March 31, 2012, for the provision of human resource, financial, administrative and regional services affected by the implementation of the new Department of Child, Youth and Family Services.

             (8)  Notwithstanding the Financial Administration Act, the Treasury Board may transfer sums voted within the Department of Natural Resources to the Department of Justice during the fiscal year ending March 31, 2012 for the provision of human resource, financial and administrative services for the transfer of personnel related to the Inland Fish Enforcement Program.

             (9)  Notwithstanding the Financial Administration Act, the Treasury Board may transfer sums voted within the Department of Justice to the Department of Natural Resources during the fiscal year ending March 31, 2012, for the provision of human resource, financial and administrative services for the transfer of personnel related to the Inland Fish Enforcement Program.
