EXPLANATORY NOTE

This Bill would amend section 19 of the Pharmaceutical Services Act to enhance the power of the minister to remove a drug from the formulary where the manufacturer does not comply with pricing requirements.

Be it enacted by the Lieutenant-Governor and House of Assembly in Legislative Session convened, as follows:

SNL2006 cP-12.01 as amended

        1. Subsection 19(4) of the Pharmaceutical Services Act is amended by adding immediately after paragraph (a) the following:

          (a.1)  the manufacturer does not comply with pricing requirements set out in the regulations;
