EXPLANATORY NOTE

This amendment to the Public Utilities Act would provide corporate status to the Board of Commissioners of Public Utilities and provide statutory immunity for personal liability to the commissioners and the employees of the board.

AN ACT TO AMEND THE PUBLIC UTILITIES ACT

        Be it enacted by the Lieutenant-Governor and House of Assembly in Legislative Session convened, as follows:

1. (1) Subsection 6(1) of the Public Utilities Act is repealed and the following substituted:


Appointment of board of commissioners and staff


6. (1) There is established a corporation to be known as the Board of Commissioners of Public Utilities which shall consist of 3 full-time members and not more than 6 part-time members.


(2) Section 6 of the Act is amended by adding immediately after subsection (11) the following:

(11.1) No action or other proceeding lies against the Board of Commissioners of Public Utilities or a member, officer or employee of the board for anything done in good faith in the course of carrying out its or his or her duties under the Act.
