Under the authority of section 145 of the Canada‑Newfoundland Atlantic Accord Implementation Newfoundland Act, the Lieutenant‑Governor in Council makes the following regulations.

CNR 748/96

        1. Section 2 of the Offshore Petroleum Drilling Newfoundland Regulations is amended by inserting immediately after paragraph (g) the following:

          (g.1)  "certificate of fitness" means a certificate, in the form satisfactory to the board or to a person designated by the board, issued by a certifying authority according to section 4 of the Offshore Certificate of Fitness Newfoundland Regulations;

          (g.2)  "certifying authority" has the same meaning as in section 2 of the Offshore Certificate of Fitness Newfoundland Regulations;

        2. Section 6 of the regulations is amended by adding immediately after paragraph (a) the following:

          (a.1)  the operator shall conduct the drilling operations in accordance with the contingency plans referred to in section 64;

          (a.2)  the operator shall conduct the drilling operations according to any conditions imposed relating to an approval referred to in paragraph (b);

          (a.3)  a certificate of fitness shall be obtained for each drilling installation and accommodation installation and shall continue to be valid and in force;

        3. Sections 17 to 20 and 24, paragraphs 27(1)(b) and (c), section 29, subsection 31(2), sections 32 to 44 and subsection 87(1) are repealed.
