Under the authority of subsection 4(2) of the Packaging Material Act, the Lieutenant-Governor in Council makes the following regulations.

1. Section 10 of the Beverage Container Control Regulations is amended by adding the following immediately after subsection (2):

(2.1) Notwithstanding subsection (2), surplus funds referred to in subsection (2) may be held in the operating budget of the board to provide for expenditures of the board in subsequent years.
