authority of subsection 65(1) of the Occupational
Health and Safety Act, the Lieutenant-Governor in Council makes the

Amdt. CNR 1165/96 1. Section 2 of the Occupational Health and Safety Regulations is amended by adding
immediately after paragraph (d) the following: (d.1) "director"
means the director of the Occupational Health and Safety Inspection Division of
the department; 2. Section 4 of the regulations is amended by
deleting the word "are" and substituting the words "shall
be". 3. Paragraph 6(a) of the regulations is repealed
and the following substituted: (a) make
proper use of all necessary safeguards, safety devices and appliances (i) designated and provided for his or her protection by his or her
employer, or (ii) required under the regulations to be used and worn by him or her;
and 4. Subsection 8(1) of the regulations is amended
by deleting the phrase "to an approved refuse disposal area or site". 5. Subsection 21(6) is repealed. 6. (1) Subsection 25(2) of the regulations is
repealed and the following substituted: (2) An
employer may, in writing, apply to the director or other person authorized by
the minister requesting to be exempted from the requirement to use a substitute
under subsection (1) and the director may, (a) where
he or she is of the opinion that the use of the substitute is not reasonably
practicable, permit the use of the requested chemical substance instead of its
substitute; (b) subject
to terms and conditions that he or she may establish, permit the use of a
requested chemical substance; or (c) prohibit
the use of a chemical substance and require the use of a substitute substance. (2) Subsection
25(5) of the regulations is amended by deleting the word "and" where
it first occurs and substituting the word "or". 7. (1) Paragraph 29(3)(d) of the regulations is
amended by deleting the word "and" and substituting the word
"or". (2) Subsection
29(15) of the regulations is amended by renumbering it as subsection (5). 8. Subsection 52(8) of the regulations is
repealed. 9. Subsection 60(2) of the regulations is amended
by deleting the word "tradesmen" and substituting the word
"tradespersons". 10. Subsection
81(5) of the regulations is amended by deleting the word "indication"
and substituting the word "identification". 11. Sections
106 and 107 of the regulations are amended by deleting the word
"flagmen" wherever it occurs and substituting the word
"flagpersons" and by deleting the word "flagman" wherever
it occurs and substituting the word "flagperson". 12. Subsection
115(1) of the regulations is amended by adding immediately after the word
"section" the words "and sections 116 to 124". 13. Subsection
116(2) of the regulations is amended by deleting the phrase "The control
of" and substituting the phrase "A control in or on". 14. Subsection
118(1) of the regulations is amended by deleting the words "or guard". 15. Subsection
120(4) of the regulations is amended by deleting the number "3.05"
and substituting the number "5.5". 16. Subsection
124(8) of the regulations is amended by deleting the word "signalmen"
and substituting the words "signal persons". 17. Subsection
158(1) of the regulations is amended by deleting the phrase "Health and
Safety Standards Branch of the division" and substituting the phrase
"Occupational Health and Safety Inspection Division". 18. Subsection
167(5) of the regulations is amended by deleting the phrase "the powers of
the Department of Mines and Energy" and substituting the phrase "the
provisions of and the powers of persons acting under the Mines Act". 19. Table
2 of subsection 168(1) of the regulations is amended by adding immediately
after the last line of the table the following: Note:
"Walkie Talkie" five watt power on 26.96 to 27. 23 MHZ - minimum

182(e) of the regulations is amended by deleting the word "meal" and
substituting the word "metal". 21. (1) Subsection 183(1) of the regulations is repealed and the following
