Under the authority of section 3 of the City of Mount Pearl Act the Lieutenant‑Governor in Council makes the following Order.

Short title

        1. This Order may be cited as the City of Mount Pearl Order, 1999.

Boundaries

        2. The boundaries of the City of Mount Pearl are as set out in the Schedule.

Repeal

        3. The City of Mount Pearl Boundary Order, Consolidated Newfoundland Regulation 740/96, is repealed.


Schedule

City of Mount Pearl Municipal Boundary

Beginning at a point on the southern side of the Newfoundland T'Railway Provincial Park at the western periphery of the proposed east/west arterial road at co-ordinates north 5,264,290 metres and east 321,762 metres;

Then along the southern sideline of the Newfoundland T'Railway Provincial Park running southwestward 535 metres, more or less, to a point at co-ordinates north 5,264,233 metres and east 321,231 metres;

Then following a fenceline south 18° 30' west 18.5 metres, more or less, and south 67° 15' west 242 metres, more or less, and south 62° 45' west 126 metres, more or less, and south 60° 15' west 89 metres, more or less, to a point at co-ordinates north 5,264,020 metres and east 320,812 metres;

Then proceeding along that fenceline south 81° 45' west 96 metres, more or less, and south 80° west 200 metres, more or less, to a point at co-ordinates north 5,263,972 metres and east 320,520 metres;

Then south 71° 30' west 275 metres, more or less, to a point having co-ordinates north 5,263,882 metres and east 320,261 metres, that point being on the northern boundary of the Mount Pearl sports facilities;

Then by way of those sports facilities south 1° 00' 00" east 160 metres, and south 89° 00' 00" west 125.958 metres, and south 52° 57' 59" west 128.221 metres, and south 53° 20' 27" west 140.013 metres, and south 53° 55' 08" west 85.299 metres to a point on the St. John's Urban Region (Agriculture) Development Area boundary (as gazetted in Vol. 66, No. 23, June 7, 1991);

Then following that ADA Boundary (in reverse) south 38° 15' east 34 metres, more or less, to a point having co-ordinates north 5,263,480 metres and east 319,870 metres, and south 50° west 45 metres to a point having co-ordinates north 5,263,450 metres and east 319 840 metres, and south 40° 00' east 290 metres to a point at co-ordinates north 5,263,225 metres and east 320,025 metres, and north 74° east 60 metres to a point having co-ordinates north 5,263,240 metres and east 320,085 metres, and south 41° east 365 metres, more or less, to a point on the western boundary of land now or formerly owned by L. & S. Holdings Ltd.;

Then by way of that land in a clockwise direction to the northwest corner of land now or formerly owned by the Newfoundland Telephone Co.;

Then in a southeasterly direction along the western boundary of that land to, and then crossing Brookfield Road to the southern sideline of that road;

Then in a southwesterly direction along the southern sideline of Brookfield Road to the eastern sideline of Commonwealth Avenue (extension);

Then in a southerly direction along the eastern sideline of Commonwealth Avenue (extension) to Pitts  Memorial Drive (Route 2);

Then nevertheless excluding all ramps, in a general westerly direction along the northern sideline of Route 2, to the Trans Canada Highway (Route 1);

Then nevertheless excluding all ramps in a northeasterly direction along the eastern sideline of Route 1 to the southern sideline of Kenmount Road;

Then nevertheless excluding all ramps, in a northeasterly direction along the eastern sideline of Kenmount Road to a point situate 130 metres, more or less, northeastward along Kenmount Road from the Wyatt Boulevard intersection, that point having co-ordinates north 5,266,600 metres and east 319,600 metres;

Then running southeastward along a fenceline between land now or formerly owned by G.G.R. Parsons and E.C. Hiscock to a point at co-ordinates north 5,266,201.5 metres and east 319,840 metres, that point bearing south 31° east 466 metres, more or less, from the last given point;

Then following the northern sideline of a 30 metre right of way along the southern line of the Hiscock property running north 87° 13' east 240 metres, more or less, to a point at co-ordinates north 5,266,213 metres and east 320,079 metres;

Then running due east along property now or formerly of the Butler Estate traditionally known as "Rossland" 289 metres, more or less, to a point, spot elevation 209.8 metres, at co-ordinates north 5,266,213 metres and east 320,368.5 metres;

Then due south 501.5 metres, more or less, to a point at co-ordinates north 5,265,711.5 metres and east 320,368.5 metres;

Then generally following the Canadian Government Railways Microwave Site running north 65° east 573 metres, more or less, to a point, spot elevation 232.2 metres, at co-ordinates north 5,265,952 metres and east 320,889 metres;

Then following a survey cutline along the western boundary of all that piece or parcel of land formerly knows as V.L.A. Lot # 1 of the "Hans Wich Subdivision" running south 35° east 23 metres, and south 28° 30' east 380 metres, more or less, to a point on a power transmission line, that point having co-ordinates north 5,265,602 metres and east 321,084 metres;

Then running along the power line south 51° 15' west 51 metres, more or less, to a point at co-ordinates north 5,265,570 metres east 321,044 metres;

Then running south 25° 13' 42" east 221 metres, more or less, to a point on the southern sideline of Blackmarsh Road, that point having co-ordinates north 5,265,370 metres and east 321,139.5 metres;

Then following the western periphery of the proposed east/west arterial road, via the western sideline of the St. John's Regional Water Supply System Easement, proceeding south 25° 13' 42" east 666 metres, more or less, and south 10° 50' 22" east 72 metres, more or less, to a point on the north side of Topsail Road at co-ordinates north 5,264,696.4 metres and east 321,437.3 metres;

Then running eastward approximately 195 metres along the northern sideline of Topsail Road to a point at co-ordinates north 5,264,743 metres and east 321,625 metres;

Then crossing Topsail Road to and running southward via fenceline along the eastern boundary of the premises of one Kevin Walsh, and the eastern boundary of property of Muir's Marble Works, and the eastern boundary of land now or formerly owned by the Royal Garage Ltd. to a point at co-ordinates north 5,264,620 metres and east 321,670 metres, that point bearing south 20° 15' east 131 metres, more or less, from the last given point;

Then proceeding along the western periphery of the previously mentioned arterial road south 40° 30' east 56 metres, more or less, to a point at co-ordinates north 5,264,577 metres and east 321,706.5 metres, and proceeding approximately 268 metres via the arc of a curve of radius 340 metres to a point bearing south 14° 20' east 259 metres, more or less, from the last given point, and continuing along that arterial south 11° 45' west 37.5 metres, more or less, to the point of beginning.

All bearings refer to grid north, central meridian 53° west longitude, and as with distances and co-ordinates given are subject to approximation as delineated on the 1:2500/1:1250 mapping, 1974/75/81 editions.
