Pension Benefits Act Regulations (Amendment)
under the
Pension Benefits Act, 1997
(O.C. 2000-680)

Under the authority of section 78 of the Pension Benefits Act, 1997, the Lieutenant Governor in Council makes the following regulations.

        1. (1) Subsection 41(2) of the Pension Benefits Act Regulations is amended by striking out the words and comma "Public Service Pension Plan,".

             (2)  Section 41 of the regulations is amended by adding immediately after subsection (2) the following:

             (3)  Notwithstanding subsection (1), the following provisions of the Act shall not apply to the Public Service Pension Plan:

             (a)  subsection 20(1) with respect to void amendments;

             (b)  section 35 with respect to funding;

             (c)  section 39 with respect to the 50% rule; and

             (d)  the 2 year period of time prescribed for required vesting under subsection 43(1).

Commencement

        2. These regulations shall be considered to have come into force on January 1, 2000.
