Under the authority of section 14 of the Pharmaceutical Association Act, 1994, I make the following regulations.

        1. Subsection 37(2) of the Pharmaceutical Association Regulations, 1998 is repealed and the following substituted:

             (2)  Notwithstanding paragraph (1)(aa), it is not professional misconduct for a pharmacist to disclose information relating to the selling or dispensing of drugs to a person other than the person to whom the drugs are sold or dispensed, including providing the information in the form of copies of prescriptions, where the information is disclosed

             (a)  to the person in the furtherance of

                      (i)  a lawful drug monitoring program, or

                     (ii)  a lawful investigation;

             (b)  at the request of an official of the department engaged in an audit for the purpose of gathering information relative to a prescription drug plan administered by the department; or

             (c)  to a professional involved in the active treatment or care of a person.
