Labour Standards Regulations (Amendment) (Filed Under the authority of sections 26 and 27 of the Labour Standards Act, the Lieutenant-Governor in Council makes the following regulations. Dated at Deborah E. Fry REGULATIONS Analysis 1.

Subsection 9(1.2) of the Labour Standards Regulations is repealed and the following substituted: (1.2) Notwithstanding subsections (1) and (1.1), effective April 1, 2003, for the purpose of section 25 of the Act, overtime wages shall be paid at a rate of not less than one and one half an employee's regular rate of pay to those employees subject to a collective agreement negotiated after December 6, 2001 where the collective agreement, or a letter of understanding, schedule or other correspondence between the employer and a representative of the employees, attached to or forming part of the collective agreement, references an announcement of government that, effective April 1, 2003, these regulations would be amended to require all employers to pay overtime wages at a rate of not less than one and one half an employee's regular rate of pay, notwithstanding that such an amendment has not come into effect. ©Earl G.
