Short title

        1. This Notice may be cited as the Department of Forest Resources and Agrifoods Notice, 2003.

Definitions

        2. In this Notice

             (a)  "department" means the Department of Forest Resources and Agrifoods; and

             (b)  "minister" means the Minister of Forest Resources and Agrifoods.

Department restructured and reconstituted

        3. (1) The department is restructured and reconstituted by Order in Council 2001-143 and Order in Council 2003-368 and the department is presided over by the minister.

             (2)  The department consists of 2 branches, as follows:

             (a)  Forestry; and

             (b)  Agrifoods.

Powers and duties of the minister

        4. The powers, functions and duties of the minister include the supervision, control and direction of all matters relating to

             (a)  forest resources and the utilization, protection, conservation, management, surveying, mapping and development of forest resources, including silviculture;

             (b)  shared responsibility for management, preservation, protection and development of wild life and inland fisheries;

             (c)  enforcement responsibility in the areas of forestry and wildlife, and assisting in enforcement in the areas of inland fisheries, motorized snow vehicle and all-terrain vehicle use, in reserves under the Wilderness and Ecological Reserves Act and under the Migratory Bird Convention Act (Canada);

             (d)  agriculture in all its branches and in its widest sense, including, without limitation of the word "agriculture", agrifoods, agronomy, horticulture, animal husbandry, aviculture, the development of pasturage and the growing of hay and the products of agriculture, including, without limitation of the word "products", animals, meats, eggs, poultry, wool, dairy products, berries, grains, seeds, fruit, including wild fruit, fruit products, vegetables and vegetable products;

             (e)  animal health;

              (f)  food technology and marketing;

             (g)  agricultural land and the utilization, protection, conservation, management, surveying, mapping and development of agricultural land;

             (h)  in co-operation with the Minister of Mines and Energy, the use of support services from the Department of Mines and Energy; and

              (i)  the administration of the Acts set out in the Schedule and of all orders and regulations passed or made under those Acts, including those powers, functions or duties necessary or desirable for carrying out the purpose of those Acts,

which are not, or in so far as they are not, the responsibility of another minister, agency, body, corporation, board, organization or person.

Repeal

        5. The Department of Forest Resources and Agrifoods Notice, Newfoundland and Labrador Regulation 63/96, is repealed.
