Under the authority of section 123 of the Workplace Health, Safety and Compensation Act, the Workplace Health, Safety and Compensation Commission, with the approval of the Lieutenant-Governor in Council makes the following regulations.

        1. Section 27 of the Workplace Health, Safety and Compensation Regulations is repealed and the following substituted:

Deduction from payroll

     27. Under section 102 of the Act, in computing and adjusting the amount of the payroll of an employer, an amount in excess of the maximum compensable earnings, calculated under section 21, paid to a worker shall be deducted from the amount of the payroll and the assessment shall be based on the payroll as reduced.

Commencement

        2. These regulations are considered to have come into force on January 1, 2005.
