Under the authority of subsection 65(3) of the Occupational Health and Safety Act, the Lieutenant-Governor in Council makes the following regulations.

        1. (1) Subsections 187.1(1) and (1.1) of the Occupational Health and Safety Regulations are repealed and the following substituted:

Diving standards

187.1 (1) The following standards respecting diving operations, including amendments to them, are adopted and constituted as part of these regulations:

             (a)  CAN/CSA-Z275.4-02 "Competency Standard for Diving Operations"; and

             (b)  CAN/CSA-Z275.2-04 "Occupational Safety Code for Diving Operations".

          (1.1)  Notwithstanding paragraph (1)(a), the following modifications to CAN/CSA-Z275.4-02 "Competency Standard for Diving Operations" apply to seafood harvesting and aquaculture diving operations:

             (a)  clause 7, SCUBA Supervisor (Restricted and Unrestricted) is struck and the following substituted:

                      (i)  Individuals who have successfully completed a five-day Surface Safety Attendant's course approved by the Workplace Health, Safety and Compensation Commission may supervise seafood harvesting and aquaculture diving operations.

             (2)  Subsection 187.1(3) of the regulations is repealed.
