Under the authority of section 30 of the Buildings Accessibility Act, the Lieutenant-Governor in Council makes the following regulations.

        1. (1) Paragraph 2(s) of the Buildings Accessibility Regulations is repealed and the following substituted:

             (s)  "principal entrance" means an entrance in a building which is intended for general use by the public or employees or both the public and employees, and there may be more than one principal entrance;

             (2)  Paragraph 2(u) of the regulations is amended by inserting immediately before the word "exit" the word "an".

 

        2. Section 3 of the regulation is repealed and the following substituted:

Codes and standards

        3. (1) The following codes and all revisions and amendments as are made are adopted as modified and amended in Schedule A:

             (a)  N.R.C.C. the National Building Code of Canada, 1990; and

             (b)  Canadian Standards Association Can/CSA-B651-M90 Barrier-Free Design.

 

        3. (1) Section 4 of the regulations is amended by deleting the phrase "physically disabled persons" wherever it occurs and by substituting the phrase "persons with disabilities".

             (2)  Subsection 4(5) of the regulations is repealed and the following substituted:

             (5)  A lodging house, boarding house or bed and breakfast which accommodates more than 10 boarders, lodgers or guests shall have

             (a)  at least one room with sleeping accommodations that are accessible to physically disabled persons; and

             (b)  the entrance and facilities normally used by the boarders, lodgers or guests shall be accessible to physically disabled persons.

 

        4. Section 8 of the regulations is amended by deleting the figure "1%" and by substituting the figure "4%".

 

        5. (1) Paragraph 9(3)(a) is repealed and the following substituted:

             (a)  the building addition contains a principal entrance;

             (2)  Subsection 9(3) of the regulations is amended by adding immediately after paragraph (a) the following:

          (a.1)  the building addition affects other areas of the buildings where the building addition is greater than 300 square metres; or

 

        6. Subparagraph 11(f)(i) of the regulations is amended by deleting the words "metres squared" and by substituting the words "square metres".

 

        7. Section 12 of the regulations is repealed and the following substituted:

Elevating devices

      12. Where an elevating device is provided, independent operation shall be possible without the assistance of keys or personnel.

 

        8. Section 13 of the regulations is repealed and the following substituted:

Public telephones

      13. Where public telephones are provided

             (a)  at least one telephone in each bank of telephones shall be accessible to persons using a wheelchair and as in subsection 34(1) of the Schedule; and

             (b)  at least one telephone in each area where telephones are provided shall be accessible for use by deaf and hard of hearing persons as in subsection 34(2) of the Schedule.

 

        9. Section 14 of the regulations is amended by adding immediately after subsection (1) the following:

          (1.1)  The copies of drawings and specifications of design required under subsection (1) shall be submitted prior to any construction contemplated by those drawings and specification of design taking place.

 

      10. The Schedule to the regulations is amended

             (a)  in subsection 1(5) by deleting the words "millimetres squared" and substituting the words "square metres";

             (b)  by repealing subsection 12(2) and substituting the following:

             (2)  The number of spaces designated for wheelchair use in the rooms and areas referred to in paragraph (1)(b) shall conform to Table II.

             (c)  in section 14, by deleting the phrase "physically disabled persons " and by substituting the phrase "persons with disabilities";

             (d)  in paragraph 14(c) by adding immediately after the word "aisle" the words "and colour";

             (e)  in section 15, by deleting the phrase "physically disabled persons " and by substituting the phrase "persons with disabilities;

              (f)  by adding immediately after subsection 15(3) the following:

             (4)  All designated parking stalls and access aisles shall be painted the international colour of access on the pavement of the spaces and aisles.

             (g)  in section 16, by adding immediately after subsection (3) the following:

             (4)  The number of accessible toilet stalls for washrooms of each sex shall be as follows:

             (h)  in section 17, by deleting the phrase "disabled persons" wherever it appears and by substituting the phrase "persons with disabilities";

              (i)  in subsections 18(5) and (6), by deleting the words "metres squared" wherever they appear and by substituting the words "square metres";

              (j)  in section 20, by adding immediately after the phrase "slip resistant strips" the phrase "of contrasting colors";

            (k)  by repealing paragraph 25(a) and substituting the following:

             (a)  clear and level, or level with removable seats or other flexible seating options;

              (l)  in subsection 26(1), by deleting the words "metres squared" and by substituting the words "square metres";

            (m)  in subparagraph 27(b)(ii), by deleting the number "760" and by substituting the number "800";

             (n)  in section 28, by deleting the phrase "disabled persons " and by substituting the phrase "persons with disabilities;

             (o)  in subsection 29(2) by deleting the phrase "visually impaired persons" and by substituting the phrase "persons with vision impairments";

             (p)  in section 30, by deleting the phrase "disabled persons " and by substituting the phrase "persons with disabilities;

             (q)  in section 31, by deleting the phrase "disabled persons " and by substituting the phrase "persons with disabilities;

             (r)  by repealing paragraph 34(2)(c) and substituting the following:

             (c)  have a teletype, TTY; and

             (s)  in paragraph 37(d), by deleting the semi-colon and the word "and" and by adding a comma and the phrase and semi-colon "and in each accessible room, where provided;".

Commencement

      11. These regulations shall come into force 6 months after the date of publication in the Gazette.
